UNCITRAL ASIA PACIFIC DAYS REPORT 2024

Introduction

1. This report on the UNCITRAL Asia Pacific Days (“AP Days”) highlights the objectives of this flagship activity series, the deliverables produced, and the outcomes achieved in 2024. An introduction of the UNCITRAL AP Days and an illustrated summary of the salient features of the 2024 series are provided first, followed by concluding remarks. Highlights from each activity appear in Annex I and testimonials from partnering institutions and participants appear in Annex II.

A brief overview

2. The AP Days are an annual flagship academic series launched in 2014 by the United Nations Commission on International Trade Law Regional Centre for Asia and the Pacific (“UNCITRAL” or the “Commission”, and “UNCITRAL RCAP”) to commemorate United Nations General Assembly resolution 2205 (XXI) of 172

3. Since the first edition of the AP Days in 2014, universities and institutions across the Asia-Pacific region have joined the annual celebration by co-hosting a series of academic events with UNCITRAL RCAP to promote awareness of international trade standards and norms, particularly those endorsed by UNCITRAL, amongst law students — the next generation of legal thinkers and policymakers. These events are academic in nature and are free of admission charges. In some instances, the deliverables have served to provide capacity building to public and private stakeholders and assist participating jurisdictions in their consideration of adopting UNCITRAL texts.

The Commission welcomed the increased number and variety of cooperation frameworks put in place between the secretariat, including UNCITRAL RCAP, and international, regional, and national organizations and institutions, and the results achieved so far under those cooperation frameworks, such as the expansion of the UNCITRAL Days in Africa, the Arab States, Asia and the Pacific, and Latin America and the Caribbean.1

6. The AP Days 2024 series is the eleventh edition of this UNCITRAL RCAP flagship with events taking place from March to December 2024. The series was successfully organized with the generous support and collaboration of institutional and academic partners throughout the region. Each AP Days activity had its own unique and diverse features in terms of deliverables, topics covered, audience reached, and mode of delivery. Highlights of each AP Days activity listed in chronological order can be found in Annex I.

7. The theme for AP Days 2024 was “Transparency@10”, which provided an opportunity to raise awareness among students and other stakeholders of the UNCITRAL Transparency Standards3 and how they were able to enhance investorState arbitration by: creating public knowledge of the initiation of an investor-State arbitration; allowing third-party submissions where they would be helpful and not unduly delay, interfere, or increase costs; allowing for open hearings while preserving the power of an arbitral tribunal to hold closed proceedings and restrict access to documents to protect confidential or privileged information. This creates a harmonized legal framework for a fair and efficient settlement of international investment disputes, increases transparency and accountability, and promotes good governance.

Other subject areas explored in the AP Days 2024 series included, in diminishing order of frequency, Dispute Settlement (including arbitration and mediation), International Sale of Goods (United Nations Convention on Contracts for the International Sale of Goods (CISG) and the Convention on the Limitation Period in the International Sale of Goods (Limitation Convention)), Electronic Commerce, Investor-State Dispute Settlement, Insolvency for Micro and Small Enterprises (MSEs) and International Transport of Goods. Most AP Days events began with an introduction to UNCITRAL and UNCITRAL RCAP including the online courses and the internship programme.4

Allowing submission by a third person or a non-disputing Party to the treaty leads to increased participation in arbitral proceedings. (2) The United Nations Convention on Transparency in Treaty-based Investor-State Arbitration (Mauritius Convention on Transparency) is an instrument by which Parties to investment treaties concluded before 1 April 2014 express their consent to apply the Rules on Transparency. 9. The AP Days 2024 series spanned a total of 21 events across 14 jurisdictions in the Asia-Pacific region, which observed an increase in both the numbers of events and co-hosting jurisdictions from the 2023 series.

10. As shown in the graphs below, since the launch of the AP Days in 2014, there has been an upward trend in both the numbers of events and co-hosting jurisdictions. With the resumption of in-person participation, the numbers of events and co-hosting jurisdictions still remained strong in the three-year period since 2022.6

11. Turning to a year-on-year comparison, the number of partnering institutions increased from 32 in the 2023 series to 49 in the 2024 series. There was also a marked increase in the cumulative size of the audience, from 1,366 to 2,541. Overall outreach continues to be greater than the pre-pandemic period, with online participants joining from the Asia-Pacific region and beyond as detailed in paragraph 13 below.7

12. The 14 jurisdictions which co-hosted the AP Days 2024 series were: Australia, Azerbaijan, China (including Hong Kong and Macao), India, Indonesia, Kazakhstan, Maldives, Mongolia, Republic of Korea, Russian Federation, Sri Lanka and Viet Nam; among these Azerbaijan, Mongolia and Kazakhstan were new jurisdictions hosting its inaugural AP Days event, all the more impactful as all three are landlocked developing countries (LLDCs).

13. Audience composition continued to be diverse. The AP Days 2024 events reached a global audience from 44 jurisdictions as shown in the map below, among which 11 were least developed countries (LDCs), LLDCs and small island developing states (SIDSs) (LDCs: Ethiopia, Myanmar and Nepal; LLDCs: Azerbaijan, Eswatini, Ethiopia, Kazakhstan, Mongolia, Nepal and Republic of Moldova; SIDSs: Jamaica, Maldives and Singapore).9

23. The AP Days 2024 events introduced participants to UNCITRAL’s online courses. 6 These free interactive and self-paced courses provide an overview of UNCITRAL and its texts to all interested. An electronic certificate is downloadable from the platform for users upon completion of the courses.

24. Another theme highlighted throughout the AP Days 2024 series was the UNCITRAL RCAP Internship Programme. Anchored from the UNCITRAL RCAP office in Incheon, Republic of Korea, interns improve their knowledge of international trade law principles by gaining first-hand experience about the work of UNCITRAL, the principal areas in which UNCITRAL operates, and the activities of the UNCITRAL secretariat, including technical assistance to trade law reform. UNCITRAL RCAP interns work under the direct supervision of UNCITRAL RCAP professional staff. The positions are for a duration of two to six months. The internship may be undertaken

Hanyang University School of Law (Seoul, 20 September 2024)

On 20 September 2024, UNCITRAL RCAP co-organized the AP Days event with the Hanyang University School of Law in the form of an in-person seminar, themed “Introduction to the work of UNCITRAL and RCAP, including application of UNCITRAL texts from practical perspective.”

UNCITRAL RCAP provided an overview of the work of UNCITRAL and RCAP, including the works of the Commission, its Working Groups and secretariat, summaries of the 2024 Commission report, e-modules, CLOUT system, abstracts of CLOUT cases, triannual CLOUT newsletter and internship opportunities at RCAP. Prosecutor from the International Legal Policy Division of the Korean Ministry of Justice presented on the current work done by the Division to implement the United Nations Convention on International Settlement Agreements Resulting from Mediation (Singapore Convention on Mediation), including challenges in the previous years.27

2024 UNCITRAL Asia Pacific Days China University of Political Science and Law (Beijing, 23-24 September 2024)

On 23 and 24 September 2024, UNCITRAL RCAP co-organized the AP Days event with the China University of Political Science and Law in the form of an international conference on the subject of negotiable cargo documents (NCDs). The event was held in a hybrid format. Of the 13 speakers, 7 were female and 6 were male. There were 92 participants, of which 86 attended in person while 6 participated remotely.

UNCITRAL RCAP provided the opening remarks highlighting the role of UNCITRAL in promoting harmonization and modernization of international trade law and the ongoing work of UNCITRAL on NCDs. NCDs were discussed in the context of transport law, legal obstacles and mechanisms of the multimodal transport system, practices with the use of electronic documents and UNCITRAL Model Law on Electronic Transferable Records (MLETR).28

The event was conducted in hybrid mode, with various sessions covering a broad range of topics including artificial intelligence (AI), CISG, climate change and governance, digital trade, dispute settlement, electronic commerce, LawTech, insolvency, international arbitration, ISDS, micro, small and medium-sized enterprises (MSMEs), Transparency Standards and UN SDGs.37

2024 UNCITRAL Asia Pacific Days School of Law, Far Eastern Federal University (Vladivostok, Russian Federation, 29 November 2024)

On 29 November 2024, UNCITRAL RCAP co-organized the AP Days event with School of Law, Far Eastern Federal University (FEFU). The hybrid seminar introduced students to UNCITRAL's work and RCAP activities, including an overview of UNCITRAL initiatives, internship opportunities, and updates on international arbitration and mediation.

The head of UNCITRAL RCAP presented on the Transparency Standards and Russia's contributions to UNCITRAL. The legal expert of UNCITRAL RCAP also provided an overview of the CLOUT case law database, e-learning modules and internship opportunities at RCAP. Additionally, the FEFU discussed the international commercial arbitration in the Russian process. There were 15 participants from Russia, comprised of 6 male and 9 female attendees.38

On 6 December 2024, UNCITRAL RCAP co-organized the inaugural AP Days event with Hidayatullah National Law University in Raipur. The symposium aimed to foster interdisciplinary dialogue and explore strategies to strengthen legal infrastructure for digital transformation in the Asia-Pacific region.

Regional accessibility, multilingualism, deliverables and formats

16. As with previous editions, the format of the AP Days 2024 events ranged from closed in-class lectures to full-day public international conferences. In addition to the in-person format, the events also adopted a hybrid format, with UNCITRAL staff joining remotely while students and other stakeholders joined in-person. Some of the events were virtual format only.11

17. UNCITRAL RCAP supported all the AP Days events. Colleagues from the UNCITRAL Secretariat (Vienna), including the Secretary of UNCITRAL, joined some events. Technical presentations on topics such as the CISG, investor-State dispute settlement (ISDS) and Insolvency continued to take the form of live remote presentations or, where live presentations were not possible, UNCITRAL RCAP provided tailor-made video remarks.

2024 UNCITRAL Asia Pacific Days Supporting progress towards achieving the Sustainable Development Goals

21. The AP Days 2024 events highlighted UNCITRAL’s role in harmonizing international trade law and facilitating international trade and investment, attracting diverse participation from experts and audiences. In doing so, these events advanced UNCITRAL’s support for the Sustainable Development Goals (SDGs) across multiple areas:5

UNCITRAL RCAP interns work under the direct supervision of UNCITRAL RCAP professional staff. The positions are for a duration of two to six months. The internship may be undertaken remotely, in-person or in hybrid mode at the UNCITRAL RCAP office.7

2024 UNCITRAL Asia Pacific Days Concluding remarks

25. It is hoped that, through the AP Days 2024, more students, academics, legal practitioners, policy makers and other stakeholders acquired deeper understanding of how legal harmonization facilitates international trade and investment, and the key role of UNCITRAL instruments and their uniform interpretation in that respect. In addition, as expressed by a partnering institution, the AP Days were useful for participants to observe the role that UNCITRAL RCAP plays in promoting the work and visibility of UNCITRAL in the Asia-Pacific region, engaging in coordination activities with international and regional organizations implementing trade law reform projects in the region, and providing training, research and internship opportunities.
