UNCITRAL ASIA PACIFIC DAYS REPORT 2025

Introduction

1. This report on the UNCITRAL Asia Pacific Days (AP Days) highlights the objectives of this flagship activity series, the deliverables produced and the outcomes achieved in 2025.1 An introduction to the UNCITRAL AP Days and an illustrated summary of the salient features of the 2025 series are provided first, followed by concluding remarks. Highlights from each activity appear in Annex I and testimonials from partnering institutions and participants appear in Annex II.

A brief overview

2. The AP Days are an annual flagship academic series launched in 2014 by the United Nations Commission on International Trade Law Regional Centre for Asia and the Pacific (UNCITRAL or the Commission, and UNCITRAL RCAP) to commemorate United Nations General Assembly resolution 2205 (XXI) of 17 December 1966 establishing UNCITRAL, which has since come to be the core legal body of the United Nations system in the field of international trade law.

2025 UNCITRAL Asia Pacific Days the Asia-Pacific region have joined the annual celebration by co-hosting a series of academic events with UNCITRAL RCAP to promote awareness of international trade standards and norms, particularly those endorsed by UNCITRAL, amongst law students – the next generation of legal thinkers and policymakers. These events are academic in nature and are free of admission charges. In some instances, the deliverables have served to provide capacity building to public and private stakeholders and assist participating jurisdictions in their consideration of adopting UNCITRAL texts.

The Commission welcomed the increased number and variety of co-operation frameworks put in place between the secretariat, including UNCITRAL RCAP, and international, regional and national organizations and institutions, and the results achieved so far under those cooperation frameworks, such as the expansion of the UNCITRAL Days in Africa, the Arab States, Asia and the Pacific and Latin America and the Caribbean.2

6. The AP Days 2025 series is the eleventh edition of this UNCITRAL RCAP flagship with events taking place from September 2025 to March 2026. The series was successfully organized with the generous support and collaboration of institutional and academic partners throughout the region. Each AP Days activity had its own unique and diverse features in terms of deliverables, topics covered, audience reached, and mode of delivery. Highlights of each AP Days activity listed in chronological order can be found in Annex I.

Theme and main subject areas

7. The theme for AP Days 2025 was "End-to-End Trade Digitalization", which provided an opportunity to raise awareness among students and other stakeholders of how UNCITRAL instruments collectively create a legally enabling framework for the digitalization of a commercial transaction from start to finish, commencing with contract formation and trade finance to cargo documentation, including electronic documents, signatures, identity management and trust services, and dispute resolution. Highlighted instruments4 include the UNCITRAL Model Law on Electronic Commerce (MLEC, 1996), Model law on Electronic Signatures (MLES, 2001) and the United Nations Convention on the Use of Electronic Communications in International Contracts (ECC, 2005), which provide legal recognition for electronic contracts and communications; the Model Law on Electronic Transferable Records (MLETR, 2017); the Model Law on Automated Contracting (MLAC, 2024), which addresses contracts concluded by automated systems including artificial intelligence, the draft United Nations Convention on Negotiable Cargo Documents (the Accra Convention, 2025), which modernize the legal framework for electronic transport documentation and trade finance; and the UNCITRAL project on Dispute Resolution in the Digital Economy (DRDE), which monitors and analyses developments in dispute resolution within the digital economy, focusing on the disruptive aspects of digitalization, particularly regarding due process and fairness, while also addressing the enabling aspects of technology's impact on costs and procedures.

In addition to digitalization, other subject areas explored in the AP Days 2025 series included, in diminishing order of frequency, an introduction to the Case Law on UNCITRAL Texts (CLOUT) system, dispute settlement (including international commercial arbitration and mediation), uniform sales law (including the United Nations Convention on Contracts for the International Sale of Goods (CISG)), investor–State Dispute Settlement (ISDS) and the UNCITRAL Transparency Standards in treatybased investor–State arbitration, international transport of goods, and cross-border insolvency. Most AP Days events began with an introduction to UNCITRAL, including the online courses and the internship programme.5

Level of participation

9. The AP Days 2025 series spanned a total of 24 events across 16 jurisdictions in the Asia-Pacific region, which observed an increase from the 2024 series in both the numbers of events (a 14.3% increase compared with 21 events in 2024) and cohosting jurisdictions (also a 14.3% increase compared with 14 co-hosting jurisdictions in 2024).

10. As shown in the graphs below, since the launch of the AP Days in 2014, there has been an upward trend in both the numbers of events and co-hosting jurisdictions. With an increasing resumption of in-person participation or hybrid modalities, the numbers of events and co-hosting jurisdictions still remained strong in the three-year period since 2023, with the 2025 series surpassing pandemic levels which comprised exclusively online modalities and peaked in 2021.6

11. Turning to a year-on-year comparison, the number of partnering institutions increased from 49 in the 2024 series to 51 in the 2025 series. Overall outreach continues to be greater than during the pre-pandemic period, with online participants joining from the Asia-Pacific region and beyond as detailed in paragraph 13 below.7

12. The 16 jurisdictions which co-hosted the AP Days 2025 series were: Bhutan, China (including Hong Kong and Macao), India, Indonesia, Japan, Kazakhstan, Maldives, Mongolia, Pakistan, Republic of Korea, Russian Federation, Sri Lanka, Thailand and Viet Nam. Among these, Bhutan and Pakistan co-hosted AP Days events for the first time. Of the 16 co-hosting jurisdictions, three of them (Bhutan, Mongolia and Kazakhstan) are landlocked developing countries (LLDCs).

Participation, audience diversity and gender parity

13. Audience composition continued to be diverse. The AP Days 2025 events reached a global audience from at least 43 jurisdictions as shown in the map below, among which at least 16 were least developed countries (LDCs: including Cambodia, Côte d’Ivoire, Democratic Republic of the Congo, Lao People’s Democratic Republic, Liberia, Myanmar, Somalia and United Republic of Tanzania), LLDCs (including Bhutan, Kazakhstan, Lao People’s Democratic Republic, Mongolia, Republic of Moldova, Uzbekistan and Zimbabwe) and small island developing States (SIDS:

2025 UNCITRAL Asia Pacific Days Supporting progress towards achieving the Sustainable Development Goals

21. The AP Days 2025 events highlighted UNCITRAL’s role in harmonizing international trade law and facilitating international trade and investment, attracting diverse participation from experts and audiences. In doing so, these events advanced UNCITRAL support for the Sustainable Development Goals (SDGs) across multiple areas:6

Goal 4 : Ensuring inclusive and equitable quality education and promoting lifelong learning opportunities for all; Goal 8 : Promoting sustained, inclusive and sustainable economic growth, full and productive employment and decent work for all; Goal 9 : Building resilient infrastructure, promoting inclusive and sustainable industrialization and fostering innovation; Goal 10 : Reducing inequality within and among countries; Goal 13 : Taking urgent action to combat climate change and its impacts; Goal 16 : Promoting peaceful and inclusive societies for sustainable development, providing access to justice for all and building effective, accountable and inclusive institutions at all levels; and Goal 17 : Strengthening the means of implementation and revitalizing the global partnership for sustainable development.

The Q&A session featured questions on balancing efficiency and procedural fairness in ODR systems and how digital transformation affects access to justice in crossborder transactions. The event concluded with closing remarks by MCB, expressing appreciation for the collaboration with UNCITRAL RCAP and reaffirming its commitment to advancing awareness of international trade law harmonization among the next generation of legal professionals.26

2025 UNCITRAL Asia Pacific Days Sungkyunkwan University; Korea International Trade Law Association (Seoul, 24 October 2025)

On 24 October 2025, UNCITRAL RCAP held AP Days with Sungkyunkwan University (SKKU)'s Institute of Legal Studies and the Korea International Trade Law Association (KITLA). Under the theme "Regulatory Responses to the Changing Global Trade Environment", the in-person event drew 35 participants (15 female and 20 male). UNCITRAL RCAP participated virtually, with the head of RCAP introducing UNCITRAL and the draft United Nations Convention on Negotiable Cargo Documents. Other presentations discussed the draft Convention and its implications in detail, along with trade developments in other regions of the world such as the United States and the European Union, followed by discussions led by a representative from the Ministry of Trade, Industry and Energy of the Republic of Korea.27

2025 UNCITRAL Asia Pacific Days Villa College; Maldives Moot Court Society (Malé, 30 October 2025)

On 30 October 2025, Villa College and the Maldives Moot Court Society (MMCS) cohosted a virtual AP Days event as part of Maldives ADR Week. The seminar focused on reinforcing international trade through legal harmonization and the digitalization of commercial frameworks. The head of UNCITRAL RCAP delivered a keynote speech providing an introduction to UNCITRAL's mandate and the adoption status of its texts in the Maldives. She further highlighted key e-commerce instruments and the importance of UNCITRAL e-learning modules in building regional capacity. A

Presentations also considered the UNCITRAL RCAP internship programme, as well as the evolution and implications of e-commerce logistics research. The internship programme generated significant interest from participants, leading to an active Q&A session covering application eligibility, daily responsibilities, and career trajectories.36

2025 UNCITRAL Asia Pacific Days Handong Global University (Pohang, Republic of Korea, 28 November 2025)

On 28 November 2025, UNCITRAL RCAP co-organized an AP Days activity with the International Law & Justice Academic Society of Handong Global University. The event was held on a hybrid basis, with UNCITRAL RCAP speakers and some students participating online, while other students attended in person. The speakers presented on the work of UNCITRAL, including an overview of the arbitration framework, the CISG, the CLOUT database and internship opportunities. Participants were particularly interested in learning how legal harmonization is achieved and how UNCITRAL working groups navigate different legal systems cognizant of their objective to reach broad consensus rather than complete uniformity.37

2025 UNCITRAL Asia Pacific Days Far Eastern Federal University (Vladivostok, Russian Federation, 9 December 2025)

On 9 December 2025, UNCITRAL RCAP co-organized an AP Days event with the School of Law of Far Eastern Federal University. The event was held in a hybrid format, with speakers joining online and students in person. UNCITRAL speakers offered an overview of UNCITRAL and its digital trade instruments, introduced its work on dispute resolution in the digital economy, and presented the CLOUT system, online courses and internship opportunities. External speakers addressed the role of digital currencies and payment infrastructures in enhancing cross-border trade between China and the Russian Federation, the relevant international legal frameworks applicable to digital assets and automated transactions, as well as the digital transformation of international commercial arbitration, including the experience and perspectives of the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation.38

Commercial Arbitration and the UNCITRAL Arbitration Rules including the Transparency Standards, outlining their role in promoting predictable, fair and enforceable international arbitration. Presentations discussed Indonesia’s current legal framework under Law No. 30 of 1999, its alignment with the Model Law, and potential reforms to strengthen Indonesia as an arbitral seat. Speakers also analyzed the opportunities and challenges of UNCITRAL Rules in Indonesia-seated arbitration, including party autonomy, procedural flexibility and judicial supervision. The discussion linked effective arbitration systems with foreign investment, legal certainty and regional competition for dispute resolution hubs. Speakers also considered resources and topics such as CLOUT, UNCITRAL online courses and UNCITRAL RCAP internship opportunities.46

Across 4 and 5 March 2026, UNCITRAL RCAP co-organized the Viet Nam AP Days event with the Ministry of Foreign Affairs of Viet Nam, the Foreign Trade University, Ho Chi Minh City University of Law, Vietnam National University and The Chinese University of Hong Kong. Following the co-opening remarks delivered by the Secretary of UNCITRAL, presentations highlighted the rapid evolution of international carbon markets and the need for coherent legal frameworks to support their integrity and growth. Speakers emphasised the interaction between trade law, climate policy and private law, including challenges in classifying carbon credits, ensuring regulatory compatibility and managing cross-border transactions. Regional perspectives – particularly from the European Union and Viet Nam – illustrated developments in carbon pricing, market integration and legal reform to encourage private sector participation. Overall, the discussions underscored the importance of legal clarity, international coordination including potential legal harmonization and robust governance to enable effective and credible carbon markets.47

From 6–8 March 2026, the 8th Arun Jaitley International Insolvency and Bankruptcy Moot was successfully convened at National Law University Delhi, co-organized with its Centre for Transnational Commercial Law (CTCL) and supported by Insolvency and Bankruptcy Board of India (IBBI), INSOL India and the Insolvency Law Academy.

As a core partner, UNCITRAL RCAP anchored the moot in its global cross-border insolvency framework, including the Model Law on Cross-Border Insolvency and enterprise group insolvency standards. It also showcased practical tools such as CLOUT, online learning modules and internship opportunities, bridging academic debate with real-world insolvency practice.

Over three days, the event brought together legal professionals and students across the Asia Pacific to deliberate on insolvency reform, culminating in a valedictory session with distinguished dignitaries, reinforcing the importance of regional alignment with UNCITRAL standards and the value of capacity-building in cross-border insolvency matters for future practitioners.48

14. The composition of speakers was similarly diverse. In addition to experts from co-hosting jurisdictions, the AP Days 2025 series engaged speakers based in Austria, Belgium, Canada, France, Italy, Malaysia, Nigeria, Türkiye, the United Kingdom and the United States, adding international perspectives to the discussions.10

15. Based on available information from the co-organizers, gender parity is demonstrated in participants and speakers, with over 52% of the participants and nearly 54% of speakers identifying as women.

Regional accessibility, multilingualism, deliverables and formats

16. As with previous editions, the format of the AP Days 2025 events ranged from closed in-class lectures to full-day public international conferences. In addition to the in-person format, many events continued to adopt a hybrid format, with UNCITRAL staff joining remotely while students and other stakeholders joined in-person. Some of the events were virtual format only.11

17. UNCITRAL RCAP supported all the AP Days events. Colleagues from the UNCITRAL secretariat (Vienna), including the Secretary of UNCITRAL, joined some events. Technical presentations on topics such as the CISG, digital trade instruments, investor–State dispute settlement, insolvency and new instruments such as the draft United Nations Convention on Negotiable Cargo Documents continued to take the form of live presentations either in-person or remotely. Where live presentations were not possible, UNCITRAL RCAP provided tailor-made video remarks.
