| s - =z 4 La seguridad | Mindefensa Dirección General Marítima es de todos 4 Autoridad Marítima Colombiana RESOLUCIÓN NÚMERO ( 0728-2020) MD-DIMAR-SUBMERC-AREM 29 DE OCTUBRE DE 2020 “Por medio de la cual se adicionan unos artículos al Capítulo 1 del Título 9 de la Parte 2 del REMAC 4 “Actividades Marítimas”, en lo concerniente a acoger en el ámbito nacional las resoluciones del Comité de Seguridad Marítima y por la Conferencia de los Estados Parte de dicho Convenio, por medio de las cuales se modifican los Capítulo IX en lo relacionado a la Gestión de la Seguridad operacional de los buques, el Capítulo X respecto a las Medidas de Seguridad aplicable a las naves de gran velocidad, el Capítulo XI-1 concerniente a las Medidas especiales para incrementar la seguridad marítima, y el Capítulo XI-2 relativo a las Medidas especiales para incrementar la protección marítima, del Convenio Internacional para la Seguridad de la Vida Humana en el Mar (SOLAS enmendado)” = X = = - & E EA = = = ES: == EL DIRECTOR GENERAL MARÍTIMO En uso de sus facultades legales, particularmente en las contenidas en el numeral 5 del artículo 5 del Decreto Ley 2324 de 1984 y en el numeral 4 del artículo 2 del Decreto 5057 de 2009 y CONSIDERANDO Que Colombia se adhirió mediante la Ley 8 de 1980 al Convenio Internacional para la Seguridad de la Vida Humana en el Mar de 1974 y su Protocolo de 1978, mediante la cual acogió tanto el texto del convenio como todos los anexos técnicos.
Que Colombia se adhirió mediante la Ley 8 de 1980 al Convenio Internacional para la Seguridad de la Vida Humana en el Mar de 1974 y su Protocolo de 1978, mediante la cual acogió tanto el texto del convenio como todos los anexos técnicos. Que el artículo VIII de dicho Convenio, determina que las enmiendas a los capítulos Il a VIII del Anexo —en que figuran las disposiciones técnicas del Convenio— se considerarán aceptadas transcurrido un plazo de dos años (o al término de un plazo diferente fijado en el momento de la aprobación) a menos que sean rechazadas, dentro de un periodo especificado, por un tercio de los Gobiernos Contratantes o por un número de Gobiernos Contratantes cuyas flotas mercantes combinadas representen como mínimo el 50% del tonelaje bruto de la flota mercante mundial. Que el artículo 26° de la Ley 730 de 2001 establece que las naves y artefactos navales deben reunir las condiciones de seguridad previstas en la legislación nacional y en los convenios internacionales. Que la Dirección General Marítima es la Autoridad Marítima Nacional que ejecuta la política del Gobierno en materia marítima y tiene por objeto la dirección, coordinación y A2-00-FOR-D19-U1Resolución No 0728-2020 - MD-DIMAR-SUBMERC-AREM de 29 de octubre de 2020 2 control de las actividades marítimas, en los términos señalados en el Decreto Ley 2324 de 1984. Que numeral 5 del artículo 5° del Decreto Ley 2324 de 1984 determina que la Dirección General Marítima tiene la función de regular, dirigir y controlar las actividades relacionadas con la seguridad de la navegación en general y la seguridad de la vida humana en el mar.

Que el numeral 6 del artículo 5° del Decreto Ley 2324 de 1984, asigna a la Dirección General Marítima la función de autorizar la operación de las naves y artefactos navales en aguas colombianas. Que la Dirección General Marítima es la autoridad designada por el Gobierno Nacional para la implementación y el cumplimiento de los instrumentos internacionales marítimos, en ejercicio de las disposiciones contenidas en el artículo 2 del decreto 5057 del 30 de diciembre de 2009. = X = = - & E EA = = = ES: == Que el numeral 4 del artículo 2 del Decreto 5057 de 2009, establece como función de la Dirección General Marítima dictar las reglamentaciones técnicas relacionadas con las actividades marítimas y la seguridad de la vida humana en el mar. Que mediante Resolución No. 135 del 27 de febrero de 2018 se expidió el Reglamento Marítimo Colombiano (REMAC), el cual en su artículo 3% determinó la estructura, incluyendo en el REMAC 4: “Actividades Marítimas”, lo concerniente a la Seguridad Marítima. Que dando cumplimiento a lo dispuesto en el artículo 5° de la Resolución número 135 de 27 de febrero de 2018, se hace necesario adicionar unos artículos al Capítulo 1 del Título 9 de la Parte 2 del REMAC 4, en lo concemiente a acoger en el ámbito nacional las resoluciones del Comité de Seguridad Marítima y de la Conferencia de los Estados Parte de la Organización Marítima Internacional, por medio de las cuales se modifican los
9 de la Parte 2 del REMAC 4, en lo concemiente a acoger en el ámbito nacional las resoluciones del Comité de Seguridad Marítima y de la Conferencia de los Estados Parte de la Organización Marítima Internacional, por medio de las cuales se modifican los capítulos V sobre seguridad de la navegación, VI respecto al transporte de cargas y combustible líquido y VII en lo relacionado al transporte de mercancías peligrosas, del Convenio Internacional para la Seguridad de la Vida Humana en el Mar (SOLAS enmendado) Que en mérito de lo anterior, el Director General Marítimo RESUELVE: ARTÍCULO 1. Adiciónense los siguientes artículos al Capítulo 1 del Título 9 de la Parte 2 del REMAC 4, en los siguientes términos Artículo 4.2.9.1.12. Acoger en el ámbito nacional la resolución 1 de la Conferencia de 1994 de los Gobiernos Contratantes de la Convención Internacional para la Seguridad de la Vida Humana en el Mar de 1974, exclusivamente en lo pertinente a la modificación del Capítulo IX sobre la Gestión de la Seguridad Operacional de los Buques del Convenio (SOLAS enmendado), la cual formará parte integral de la presente resolución. Artículo 4.2.9.1.13. Acoger en el ámbito nacional las resoluciones emitidas por el Comité de Seguridad Marítima de la Organización Marítima A2-00-FOR-D19-U1Resolución No 0728-2020 - MD-DIMAR-SUBMERC-AREM de 29 de octubre de 2020 3 Internacional, exclusivamente en lo pertinente a la modificación del Capítulo IX sobre la Gestión de la Seguridad Operacional de los Buques del Convenio
Internacional, exclusivamente en lo pertinente a la modificación del Capítulo IX sobre la Gestión de la Seguridad Operacional de los Buques del Convenio Internacional para la Seguridad de la Vida Humana en el Mar (SOLAS enmendado), en los siguientes términos:
1. Resolución MSC. 99 (73) del 5 de diciembre de 2000, en vigor desde el 01 enero 1994.
2. Resolución MSC. 194 (80) del 20 de mayo de 2005, en vigor desde 01 enero 2007.
Parágrafo. Las resoluciones del Comité de Seguridad Marítima de la OMI, por medio de las cuales se modifica el capítulo IX sobre la Gestión de Seguridad Operacional de los Buques del Convenio Internacional para la Seguridad de la Vida Humana en el Mar (SOLAS enmendado), contenidas en el presente artículo forman parte integral de la presente Resolución. = X = = - & E EA = = = ES: == Artículo 4.2.9.1.14. Acoger en el ámbito nacional la resolución 1 de la Conferencia de 1994 de los Gobiernos Contratantes de la Convención Internacional para la Seguridad de la Vida Humana en el Mar de 1974, exclusivamente en lo pertinente a la modificación del Capítulo X sobre las Medidas de Seguridad Aplicable a las Naves de Gran Velocidad del Convenio (SOLAS enmendado), la cual formará parte integral de la presente resolución. Artículo 4.2.9.1.15. Acoger en el ámbito nacional la Resolución MSC. 99 (73) del 5 de diciembre de 2000 en vigor desde el 01 de Julio del 2002, exclusivamente en lo pertinente a la modificación del Capítulo X sobre las

Artículo 4.2.9.1.16. Acoger en el ámbito nacional la resolución 1 Conferencia de los Gobiernos Contratantes del Convenio Solas de 1994 del Convenio Convención Internacional para la Seguridad de la Vida Humana en el Mar de 1974, exclusivamente en lo pertinente a la modificación del Capítulo XI sobre las Medidas Especiales para Incrementar la Seguridad Marítima del Convenio (SOLAS enmendado), la cual formará parte integral de la presente resolución. ARTÍCULO 4.2.9.1.17. Acoger en el ámbito nacional la resolución 1 de la Conferencia de los Gobiernos Contratantes 2002 de la Convención Internacional para la Seguridad de la Vida Humana en el Mar de 1974, exclusivamente en lo pertinente a la modificación del Capítulo XI sobre Medidas Especiales para Incrementar la Seguridad Marítima del Convenio (SOLAS enmendado), la cual formará parte integral de la presente resolución. Artículo 4.2.9.1.18. Acoger en el ámbito nacional la resolución MSC. 47(66), 4 de junio de 1996, (Construcción, compartimentado y estabilidad), en vigor desde el 1 julio 1998, emitida por el Comité de Seguridad Marítima de la Organización Marítima Internacional, exclusivamente en lo pertinente a la

Artículo 4.2.9.1.20. Acoger en el ámbito nacional las resoluciones emitidas por el Comité de Seguridad Marítima de la Organización Marítima Internacional, exclusivamente en lo pertinente a la modificación del Capítulo XI-1 sobre medidas especiales para incrementar la seguridad marítima del Convenio Internacional para la Seguridad de la Vida Humana en el Mar de 1974 (SOLAS 74, enmendado), así: = X = = - & E EA = = = ES: ==

Parágrafo. Las resoluciones del Comité de Seguridad Marítima de la OMI, por medio de las cuales se modifica el Capítulo XI-1 sobre las Medidas Especiales Para Incrementar la Seguridad Marítima del Convenio Internacional para la Seguridad de la Vida Humana en el Mar (SOLAS enmendado), contenida en el presente artículo forman parte integral de la presente resolución. Artículo 4.2.9.1.21. Acoger en el ámbito nacional la resolución 2 de la Conferencia de los Gobiernos Contratantes 2002 en vigor desde el 01 de julio de 2004, de la Convención Internacional para la Seguridad de la Vida Humana en el Mar de 1974, exclusivamente en lo pertinente a la modificación

A2-00-FOR-D19-U1Resolución No 0728-2020 - MD-DIMAR-SUBMERC-AREM de 29 de octubre de 2020 5 Artículo 4.2.9.1.22. Acoger en el ámbito nacional la resolución 194 (80) del 20 de mayo de 2005 del 20 de mayo de 2005, sobre Construcción, Estructura, Subdivisión y Estabilidad, Maquinaria e instalaciones eléctricas, en vigor desde 01 de julio de 2006, del Convenio Internacional para la Seguridad de la Vida Humana en el Mar de 1974 (SOLAS 74, enmendado), por medio de las cuales se modifica el Capítulo XI-2 sobre las Medidas Especiales para Incrementar la Protección Marítima del Convenio SOLAS, la cual formará parte integral de la presente resolución. ARTÍCULO 2”. Incorporación. La presente resolución adiciona unos artículos al Capítulo 1 del Título 9 de la Parte 2 del REMAC 4 “Actividades Marítimas”, en lo concemiente a acoger en el ámbito nacional las resoluciones del Comité de Seguridad Marítima y por la Conferencia de los Estados Parte de dicho Convenio, por medio de las cuales se modifican los Capítulo IX en lo relacionado a la Gestión de la Seguridad operacional de

ARTÍCULO 3”. Vigencia. La presente resolución empieza a regir a partir de su publicación en el Diario Oficial.

ADOPTION OF AMENDMENTS TO THE ANNEX TO THE INTERNATIONAL
CONVENTION FOR THE SAFETY OF LIFE AT SEA, 1974
THE CONFERENCE, RECALLING article VITI(c) of the International Convention for the Safety of Life at Sea, 1974 (hereinafter referred to as "the Convention") concerning the procedure for amending the Convention by a Conference of Contracting Govermments, HAVING CONSIDERED amendments to the Annex to the Convention proposed and circulated to the Members of the Organization and to all Contracting Governments to the Convention,
the procedure for amending the Convention by a Conference of Contracting Govermments, HAVING CONSIDERED amendments to the Annex to the Convention proposed and circulated to the Members of the Organization and to all Contracting Governments to the Convention,
1. ADOPTS, in accordance with article VIII(c)(ii) of the Convention, amendments to the Annex to the Convention, the texts of which are given in the Annexes to the present resolution;
2. DETERMINES, in accordance with article VIII(b)(vi)(2)(bb) of the
Convention, that: (a) the amendments set out in Annex 1 shall be deemed to have been accepted on 1 July 1995; and (b) the amendments set out in Amex 2 shall be deemed to have been accepted on 1 January 1998, unless, prior to these dates, more than one third of Contracting Govermments to the Convention or Contracting Governments the combined merchant fleets of which constitute not less than fifty per cent of the gross tonnage of the world's merchant fleet, have notified their objections to the amendments;
3. INVITES Contracting Goverments to mote that, in accordance with
article VIII(b)(vii)(2) of the Convention: (a) the amendments set out in Annex 1 shall enter into force on 1 January 1996; and (b) the amendments set out in Annex 2 shall enter into force on 1 July 1998, upon their acceptance in accordance with paragraph 2 above.ANNEX 1
ADDITION OF NEW CHAPTERS X AND XI TO, AND AMENDMENTS
TO THE APPENDIX TO, THE ANNEX TO THE INTERNATIONAL CONVENTION FOR THE SAFETY OF LIFE AT SEA, 1974 1 The following new chapter X is added to the Anne:

Regulation 1 Definitions For the purpose of this chapter: 1 "High Speed Craft Code (HSC Code)" means the International Code of Safety for High Speed Craft adopted by the Maritime Safety Committee of

Regulation 1 Definitions For the purpose of this chapter: 1 "High Speed Craft Code (HSC Code)" means the International Code of Safety for High Speed Craft adopted by the Maritime Safety Committee of the Organization by resolution MSC.36(63), as may be amended by the Organization, provided that such amendments are adopted, brought into force and take effect in accordance with the provisions of article VIII of the present Convention concerning the amendment procedures applicable to the Annex other than chapter I. 2 “High speed craft" is a craft capable of a maximum speed in metres per second (m/s) equal to or exceeding: 3.7 y 0.1667 where: v = displacement corresponding to the design waterline (m3). 3 "Craft constructed" means a craft the keel of which is laid or which is at a similar stage of construction. 4 "Similar stage of construction" means a stage at which: .1 construction identifiable vith a specific craft begins; and .2 assembly of that craft has commenced comprising at least 50 tonnes or 1% of the estimated mass of all structural material, whichever is the less. Regulation 2 Application 1 This chapter applies to high speed craft constructed on or after 1 January 1996, as follows: .1 passenger craft which do not proceed in the course of their voyage more than 4 h at operational speed from a place of refuge when fully laden; andE. -2 cargo craft of 500 gross tonnage and upwards which do not proceed in the course of their voyage more than 8 h at operational speed from a place of refuge when fully laden. 2 Any craft, irrespective of the date of construction, which undergoes repairs, alterations, modifications and outfitting related thereto shall continue to comply with at least the requirements previously applicable to the craft. Such a craft. if constructed before 1 January 1996, shall, as a rule, comply with the requirements for a craft constructed on or after that

Repairs, alterations and modifications of a major character, and outfitting related thereto, shall meet the requirements for a craft constructed on or after 1 January 1996 in so far as the Administration deems reasonable and practicable. Regulation 3 Requirements for high speed craft 1 Notwithstanding the provisions of chapters I to IV and regulation V/12, a high speed craft which complies with the requirements of the High Speed Craft Code in its entirety and which has been surveyed and certified as provided for in that Code shall be deemed to have complied with the requirements of chapters I to IV and regulation V/12. For the purpose of this regulation, the requirements of the Code shall be treated as mandatory. 2 The certificates and permits issued under the High speed Craft Code shall have the same force and the same recognition as the certificates issued under chapter I." 2 The folloving new chapter XI is added to the Annex:
"CHAPTER XI
SPECIAL MEASURES TO ENHANCE MARITIME SAFETY
Regulation 1 Authorization of recognized organizations Organizations referred to in regulation 1/6 shall comply with the guidelines developed by the Organization. Regulation 2 Enhanced surveys Bulk carriers as defined in regulation IX/1.6 and oil tamkers as defined in regulation 11-1/2.12 shall be subject to an enhanced programme of inspections in accordance with the guidelines adopted by the Assembly of the Organization by resolution A.744(18), as may be amended by the Organization, provided that such amendments are adopted, brought into force and take effect in accordance with the provisions of article VIII of the present Convention concerning the amendment procedures applicable to the Amex other than chapter I.Regulation 3 Ship identification number 1 his regulation applies to all passenger ships of 100 gross tonnage

Regulation 4 Port State control on operational reguirements 1 A ship when ina port of another Contracting Government is subject to control by officers duly authorized by such Government concerning operational requirements in respect of the safety of ships, when there are clear grounds for believing that the master or crew are not familiar with essential shipboard procedures relating to the safety of ships. 2 In the circumstances defined in paragraph 1 of this regulation, the Contracting Govermment carrying out the control shall take such steps as will ensure that the ship shall not sail until the situation has been brought to order in accordance with the requirements of the present Convention. 3 Procedures relating to the port State control prescribed in regulation 1/19 shall apply to thís regulation. 4 Nothing in the present regulation shall be construed to limit the rights and obligations of a Contracting Government carrying out control over operational requirements specifically provided for in the regulations.” 3 Amendments to the appendix to the Annex: Form of Safety Certificate for Passenger Ships PASSENGER SHIP SAFETY CERTIFICATE The text of footnote 3 is replaced by the following: “In accordance with the IMO Ship Identification Number Scheme, adopted by the Organization by resolution A.600(15)," .2 Formof Safety Construction Certificate for Cargo Ships
