Child Abduction Convention of 1980

Currently there are 63 States Parties, including 31 ratifications and 32 accessions. The most recent accessions came from Malta, Brazil, Uruguay, and Trinidad and Tobago. Ratification by Turkey occurred on 31 May and by Slovakia on 7 November 2000. Bulgaria, which recently became the 47th Member State of the Hague Conference, also has indicated its intention to accede. On Monday, 1 May 2000, His Excellency Mr. Omar Azziman, Minister of Justice of the Kingdom of Morocco, deposited a declaration with the depositary announcing that His Country intends to accede to the 1980 Convention.

La Convention de 1980 sur l'enlèvemen t international d'enfants

Actuellement, 63 Etats sont Parties à la Convention, dont 31 par ratification et 32 par adhésion. Les adhésions les plus récentes sont celles de Malte, du Brésil, de l’Uruguay, de la Trinité et de Tobago. La Turquie a ratifié la Convention le 31 mai et la Slovaquie le 7 novembre 2000. On 20 September 2000 the U.S. Senate approved a resolution of advice and consent to U.S. ratification of the 1993 Convention and passed detailed implementing legislation (passed a few days earlier by the U.S. House of Representatives). President Clinton signed the legislation on 6 October 2000 at the White House, thereby granting the final approval required for U.S. ratification of the Convention. Preparation for implementing the Convention, including the establishment of a computerised case -tracking system and the putting in place of a system for the accreditation of non -profit adoption agencies and for the approval of individual providers of adoption services, are expected to take over two years and will precede final ratification.

Protection of Children Convention of 1996

Currently there are signatures from the following 3 countries: Morocco, the Netherlands, and Slovakia. The Convention has 2 ratifications, Monaco and the Czech Republic.

SPECIAL COMMISSION

From 22 -28 March 2001, t he next (the fourth) Special Commission will meet in the Hague to review the operation of the 1980 Hague Convention on the Civil Aspects of International Child Abduction. With 63 States Parties to the Convention and a high level of interest in the Special Commission, the number of participants will probably be well in excess of the 125 who attended the last meeting in 1997.

A draft agenda is likely to contain six principal agenda items.

(1) The role and functioning of Central Authorities; (2) Judicial proceedings, including appeals, and enforcement issues; (3) Issues surrounding the safe return of the child (and the custodial parent where relevant); (4) Procedures for securing cross -frontier access/contact between parent and child; (5) Securing State compliance with Convention obligations; and (6) General items such as the role of the Permanent Bureau, INCADAT, judicial training, encouraging further ratifications and accessions, and nonHague States and bilateral arrangements.

It is planned to divide the Special Commission into two parts, the first concentrating on co-operation issues primarily, but not exclusively, concerning the Central Authorities, and the second part dealing more directly with the judicial process and enforcement problems. This second part of the Agenda is likely to include discussion, for example, of the following:

La prochaine Commission spéciale sur le fonctionnement pratique de la Convention de La Haye du 25 octobre 1980 sur les aspects civils de l'enlèvement international d'enfants (la quatrième) aura lieu à La Haye du 22 au 28 mars

2001. Une participation bien supérieure aux 125 qui participèrent à la réunion de 1997 est attendue, dans la mesure où la Convention rassemble 63 Etats Parties portant un grand intérêt à la Commission spéciale.

Le projet d'ordre du jour contient six thèmes principaux: (1) Le rôle et le fonctionnement des Autorités centrales, (2) Les procédures judiciaire s, y compris les recours, et l'exécution des décisions, (3) Les questions relatives à la sécurité de l'enfant (et du parent investi du droit de garde, le cas échéant), lors du retour, (4) Les procédures garantissant un droit de visite/contact transfrontièr e entre parent et enfant, (5) Assurer le respect par les Etats parties des obligations posées par la Convention, (6) Généralités et matières diverses, incluant le rôle du Bureau Permanent, INCADAT, la formation judiciaire, l'encouragement de nouvelles ratifications et adhésions, ainsi que les Etats non membres de la Conférence de La Haye et les accords bilatéraux.

Some more substantive issues will also be discussed. Among these are: the weight to be attached to the objections of children at different ages, the circumstances which justify the application of Article 13(1)(b) defences, and the interpretation of some of the key concepts of the 1980 Convention, such as habitual residence, rights of custody and acquiescence. There is likely to be a good deal of concentration on the problems associated with relocation and the issues

With careful preparation, it is hoped that the Special Commission will be able to arrive at a series of firm recommendations, especially on questions of practice and procedure— not quite a protocol, but a set of principles of go od practice which will carry great weight.

Upon the request of the French and German Ministries of Justice, the Hague Conference on Private International Law hosted a Judicial Seminar on the International Protection of Children at the Conference Centre De Ruwenberg from 3 -6 June 2000. Nearly 40 Judges from France, Germany, Italy, and the Netherlands engaged in intensive discussions on the application of the international instruments concerned with the protection of children. The Seminar provided an excellent opportunity for Judges from different jurisdictions to share knowledge, concerns, and ideas regarding the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction . At the close of the Seminar, the Judges unanimously adopted the following conclusions:

The Seminar has been an important event in establishing mutual understanding, respect and trust between the Judges from the different countries – factors which are essential to the effective operation of the international instruments concerned with the protection of children, and in particular the Hague Convention of 25 October 1980 on the Civil Aspects of Internation al Child

It is recognised that, in cases involving the international protection of children, considerable advantages are to be gained from a concentration of jurisdiction in a limited number of courts / tribunals. These advantages include the accumulation of experience among the Judges and practitioners concerned and the development of greater mutual confidence between legal systems.

5. The need for more effective methods of international ju dicial co -operation in respect of child protection is emphasised, as well as the necessity for direct communication between Judges in different jurisdictions in certain cases. The idea of the appointment of liaison Judges in the different jurisdictions, to act as channels of communication in international cases, is supported.

Further exploration of the administrative and legal aspects of this concept should be carried out. The continued development of an international network of Judges in the field of international child protection to promote personal contacts and the exchange of information is also supported.

Cela permet notamment aux juges et aux praticiens du droit d’acquérir une plus grande expérience et d’instaurer une plus grande confiance mutuelle entre les différents systèmes juridiques.

Il co nvient de souligner la nécessité d’améliorer la coopération judiciaire internationale dans le domaine de la protection de l’enfance ainsi que, dans certains cas, la nécessité d’une communication directe entre les juges de différentes juridictions. The International Child Abduction Database (INCADAT) was officially launched on 9 May 2000 by Mrs. A.J. Mulock Houwer, Director, Directorate General for Prevention, Youth, and Sanction Policy, representing the Minister of Justice of the Netherlands, Mr. A.H. Korthals. Launched from the Academy Building of the Peace Palace, INCADAT was developed by the Permanent Bureau of the Hague Conference on Private International Law under the direction of Professor William Duncan, Deputy Secretary General, Ms. Marion Ely, Attorney, and Dr. Peter McEleavy, Barrister. The database was

The database was envisioned to be both a depository and a search engine, featuring many of the leading international judicial decisions regarding the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction . Judges, Central Authorities, legal practitioners, researchers, and interested individuals can access INCADAT directly at www.incadat.com , or through the Hague Conference website, www.hcch.net. At the time of the launch, approximately 300 cases from a select number of Contracting States were available on the database. For each case there is a summary in English and French. The full text of the decisions in their original languages accompany the majority of case summaries. By December 2000, it is projected that the database will expand to 400 case summaries, including decisions from a greater representation of Contracting States. Le 9 mai 2000, la base de données sur l’enlèvement international d’enfants (INCADAT) a été officiellement présentée par Mme A.J. Mulock Houwer, Directrice de la Direction générale pour la prévention, la jeunesse et la politique de répression, représentant le Ministre de la Justice des Pays-Bas, Mr A.H. Kor thals. Présentée dans le bâtiment de l’Académie du Palais de la Paix à La Haye, INCADAT a été développée par le Bureau Permanent de la Conférence de La Haye de droit international privé sous la direction du Professeur William Duncan, Secrétaire Général adj oint, de Mlle Marion Ely, avocate, et du Dr. Peter McEleavy, avocat. La base de données est à la fois un dépôt et un moteur de recherche, regroupant un grand nombre de décisions judiciaires internationales importantes relatives à la Convention de La Haye d u 25 octobre 1980 sur les aspects civils de l’enlèvement international d’enfants . La base de données est accessible directement sur Internet ( www.incadat.com ), mais également sur le site Internet de la Conférence de La Haye ( www.hcch.net), de telle sorte que des juges, des Autorités centrales, des praticiens du droit, des chercheurs et tout individu s’intéressant
