The Permanent Bureau The Fifth meeting of the Special Commission to review the operation of the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction and to address implementation issues concerning the Hague Convention of 19 October 1996 on Jurisdiction, Applicable Law, Recognition, enforcement and co-operation in respect of Parental Responsibility and Measures for the Protection of Children took place in The Hague from 30 October-9 November 2006. Approximately 215 experts from 73 States, including Ecuador, for which the 1996 Convention entered into force on 1 November 2003, participated in the Special Commission. Fifty-six Member States of the Hague Conference, sixty-two States Parties to the 1980 Convention

Approximately 215 experts from 73 States, including Ecuador, for which the 1996 Convention entered into force on 1 November 2003, participated in the Special Commission. Fifty-six Member States of the Hague Conference, sixty-two States Parties to the 1980 Convention and 9 States Parties to the 1996 Convention attended the Special Commission. Amongst the experts, forty judges from twenty-fi ve countries participated in the discussions. In accordance with the established practice, invitations to the Meeting were extended to observers: six non-Member States, representatives of eight intergovernmental organisations as well as representatives of thirteen non-governmental organisations were in attendance. Member States, States Parties to the Conventions, nonMember States which were invited, intergovernmental organisations and non-governmental organisations made altogether a total of ninety-four. Mrs Justice Catherine McGuinness (Ireland) was elected to the Chair and Mr Justice Jacques Chamberland (Canada) chaired the last day of the meeting.

Le Bureau Permanent La Cinquième réunion de la Commission spéciale sur le fonctionnement de la Convention de La Haye du 25 octobre 1980 sur les aspects civils de l’enlèvement international d’enfants et la mise en œuvre de la Convention de La Haye du 19 octobre 1996 concernant la compétence, la loi applicable, la reconnaissance, l’exécution et la coopération en matière de responsabilité parentale et de mesures de protection des enfants s’est tenue à La Haye du 30 octobre au 9 novembre 2006. Environ 215 experts de 73 États, incluant l’Équateur, pour lequel la Convention de 1996 est entrée en vigueur le 1er novembre 2003, ont participé à la Commission spéciale. Cinquante-six États membres de la Conférence de La Haye, soixante-deux États parties à la Convention de 1980 et neuf États parties à la Convention de 1996 ont assisté à la Commission spéciale. Parmi les experts, quarante juges de vingt-cinq pays prirent part aux discussions. Conformément à l’usage, des invitations avaient été adressées à des observateurs : six États non membres de la Conférence, des représentants de huit organisations intergouvernementales mais aussi des représentants de treize organisations non gouvernementales étaient présents. The Agenda concerned successively the introduction to the statistical survey of 2003 cases; encouraging further ratifications / accessions and the accession process and acceptance of accessions; co-operation among Central Authorities; preventive measures; securing voluntary outcomes / use of mediation and other techniques; enforcement of return and contacts orders; implementation of the Hague Convention of 1996; discussion of key Convention concepts; return proceedings; judicial cooperation and communications; transfrontier access / contact and relocation; securing the safe return of the child; and regional developments and relations with “non-Hague” States. The Hague Convention of 25 October 1980 entered into force on 1 December 1983 and had seventy-six States Parties at the time of the Special Commission. The meeting of the Special Commission was thus the moment to celebrate the 25th anniversary of the Convention and its expanding geographical scope. The Special Commission mandated the Permanent Bureau to continue its work on several projects designed to support the effective implementation and operation of the 1980 and 1996 Conventions and to begin work on additional projects . The Permanent Bureau expressed gratitude for all the assistance given by the State Parties to the Permanent Bureau for many of the on-going projects. L’ordre du jour a été consacré de façon successive à la présentation de l’étude statistique portant sur les demandes déposées en 2003 ; encourager de nouvelles ratifi cations / adhésions et le processus d’adhésion et d’acceptation des adhésions ; coopération entre les Autorités centrales ; mesures préventives ; garantir les résolutions volontaires / utilisation de la médiation et autres techniques ; exécution des ordonnances de retour et de contact ; mise en œuvre de la Convention de La Haye de 1996 ; discussion des concepts-clés de la Convention ; procédures de retour ; coopération et communication judiciaires ; droit de visite / d’entretenir un contact transfrontière et déménagement ; garantir le retour de l’enfant en toute sécurité ; développements régionaux et relations avec les pays non parties à la Convention de La Haye. La Convention de La Haye du 25 octobre 1980 est entrée en vigueur le 1er décembre 1983 and comptait soixante-seize États parties à la date de la Commission spéciale. La réunion de la Commission spéciale était donc l’occasion de célébrer le 25ème anniversaire de cette Convention et l’expansion géographique de son champ d’application.
