María Kurucz Chair of Commission I, Head of Division, Department of Civil Law, Codifi cation and Private International Law, Ministry of Justice and Law Enforcement, Budapest The international recovery of maintenance was one of the fi rst areas where States decided to co-operate in the interest of those in need of support, especially children. Since then several global, regional and bilateral agreements have been adopted creating a network of international co-operation.

The question may arise: what can a new maintenance convention offer compared to the existing systems?

The experts, who decided that a new maintenance convention should be elaborated in the framework of the Hague Conference on Private International Law, were convinced that the time was ripe to make a new, global and comprehensive instrument on the basis of the experience gathered over the decades. Depuis, plusieurs accords mondiaux, régionaux et bilatéraux ont été adoptés et ont ainsi donné naissance à un réseau de coopération internationale. Que peut offrir une nouvelle convention sur les obligations alimentaires par rapport aux systèmes en place ? Without all the experience of the delegations it would have been unlikely to achieve the results, which are without precedent in a global context. The effect of the new Hague Convention is that free legal assistance will be provided to creditors in almost all child support cases. It was common experience that almost all child maintenance creditors are needy and deserving of free legal assistance. Insisting on the examination of their fi nancial circumstances with all the documentary and translation requirements would create unnecessary diffi culties and delays in the procedure. As this concern was widely shared, almost all child support cases under the new Hague Convention may start without delay and without any costs to the creditor. Similarly, many States felt that a fair maintenance system should not only help creditors, but needs to be open to debtors if - due to their changed circumstances - modifi cation of their obligation is necessary. As such a modifi cation application can generally be made only in the creditor’s State, debtors are in a diffi cult situation for asserting their rights. Experience in States where assistance is already provided to debtors shows that they are usually co-operative and ready to pay support voluntarily. Again, other delegations were persuaded about the benefi ts of such a system. Consequently the new Hague Convention makes Central Authority help available to debtors. It should not be forgotten though that the aim was not only to make a convention which goes further than existing instruments but at the same time to elaborate

The most diffi cult part of the negotiations was to fi nd the very delicate balance between these two objectives. At those stages it was most apparent how the delegations were dedicated to working together for the success of the Convention; their efforts always resulted in compromise solutions. Though the Convention contains possibilities for making reservations and declarations at certain parts and fl exible language at others, its main directions were supported by all and the Convention was accepted by consensus. Though the Convention has been adopted the work is far from being completed. In addition to the Explanatory Report, which will be of great importance for the proper application of such a complex convention, work will continue in many other respects. Forms have proved to be useful in the context of maintenance co-operation; a number of recommended forms are going to be adopted in the near future. Other work which is being carried out is the creation of a unique database of the maintenance systems of all States Parties; the so-called “country profi les” on the Hague Conference website complet, qui s’appuierait sur l’expérience acquise en plusieurs décennies. La nouvelle Convention de La Haye instaure une assistance juridique gratuite aux créanciers dans presque toutes les affaires d’aliments destinés aux enfants. De même, de nombreux États étaient d’avis que pour être équitable, un système de recouvrement des créances alimentaires doit non seulement aider les créanciers, mais être aussi ouvert aux débiteurs lorsque un changement de situation justifi e de modifi er leurs obligations. La recherche de cet équilibre si fragile a constitué le point le plus délicat des négociations, mais c’est là que la volonté réelle des délégations d’œuvrer ensemble à la réussite de la Convention a été la plus manifeste ; leurs efforts ont toujours abouti à des solutions de compromis. Bien que la Convention autorise des réserves et des déclarations en certains points et adopte une formulation souple en d’autres, ses orientations ont recueilli l’adhésion de tous et la Convention a été acceptée par consensus. During the negotiations a working group (“Administrative Co-operation Working Group”) was created to help strengthen the administrative cooperation aspect of the new Convention. There was a strong wish to maintain this networking forum on a permanent basis which would not only be useful to Central Authorities but could contribute to the work of future Special Commissions on the application of the Convention. The new Hague Convention places demands on States which decide to become parties to it. Most States will have to make some modifi cations of their existing laws and practices to be able to comply with the requirements. 1. Introduction and Framework On 23 November 2007 more than 70 States, 2 as well as the European Community, 3 successfully concluded at The Hague, after negotiations which spanned four years, the new global Hague Convention of 23

November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance,4 as well as its fi rst Protocol on the Law Applicable to Maintenance Obligations.5 The new Convention holds the promise of a new era in the international recovery of maintenance – one in which cross-border procedures, particularly in child support cases, should be simplifi ed, swift, accessible and cost effective.

Introduction et cadre Le 23 novembre 2007 à La Haye, plus de 70 États 2, ainsi que la Communauté européenne3, ont conclu, au terme de quatre années de négociations, la nouvelle Convention de La Haye du 23 novembre 2007 sur le recouvrement international des aliments destinés aux enfants et à d’autres membres de la famille4, ainsi que son premier Protocole sur la loi applicable aux obligations alimentaires5. Cette nouvelle Convention porte la promesse d’une nouvelle ère en matière de recouvrement international des aliments – une ère dans laquelle les procédures transfrontières, en particulier celles qui concernent les aliments destinés aux enfants, devraient être plus simples, rapides, accessibles et économiques.
