Jennifer Degeling Principal Legal Officer, Hague Conference on Private International Law Marion Ely Senior Legal Offi cer, Hague Conference on Private International Law Laura Martinez-Mora Adoption Programme Co-ordinator, Hague Conference on Private International Law The concepts behind, and indeed the need for, the Hague Conference International Centre for Judicial Studies and Technical Assistance have been developing gradually over the past decade. As the cross-border movement of people and transactions have increased, so too has the need for the legal and administrative frameworks established by the Hague Conventions. As an increasing number of States become Party to the Conventions, the need for implementation assistance expands in parallel. For the past decade the Hague Conference has been providing implementation assistance inter alia through diagnostic visits, advice and consultation, and judicial seminars, first on a country-by-country basis, and gradually through regional initiatives. These developments have been viewed as successful and have been generously funded by Member States of the Hague Conference on Private International Law through voluntary contributions to the Supplementary Budget.

The creation of the Centre, established earlier this year at the new Academy Building on the premises of the Peace Palace, as an integral part of the Permanent Bureau of the Hague Conference on Private International Law, put these initiatives on a more secure footing. The fi rst stage of the Centre was made possible by an initial grant from the Government of the Netherlands. Moreover its fi rst pilot programme (the Intercountry Adoption Technical Assistance Programme) was also supported by the Government of the Netherlands, and subsequently by the Government of the United States of America and the Government of Australia. Le nombre croissant d’États parties aux Conventions engendre un besoin accru d’assistance à la mise en œuvre. La Conférence de La Haye apporte depuis dix ans une aide à la mise en œuvre qui prend notamment la forme de visites de diagnostic, de conseil et de consultations et de séminaires judiciaires, lesquels ont d’abord été organisés à l’échelle nationale, et se sont progressivement inscrits dans des initiatives d’ampleur régionale. Ces actions ont été jugées fructueuses et ont été généreusement fi nancées par les États membres de la Conférence de La Haye de droit international privé au moyen de contributions volontaires au Budget supplémentaire. La création du Centre, qui a ouvert ses portes en 2007 dans le nouveau bâtiment de l’Académie au sein du Palais de la Paix et fait partie intégrante du Bureau Permanent de la Conférence de La Haye de droit international privé, leur confère une assise plus ferme. La première phase du Centre a été rendue possible par une subvention initiale du Gouvernement des Pays-Bas. The Permanent Bureau and the Centre focus on providing co-ordinated assistance under the Conventions along three major lines of action: 1) Identifying weaknesses or needs in States/regions or where a Hague Convention is about to come into operation; 2) Considering what the Hague Conference is able to offer itself and in cooperation with others (States Parties, Regional Bodies or NGOs) in the way of training and technical assistance; and 3) Examining how to access any necessary funding.

In particular the Centre: deals with requests for assistance; assists with the scheduling and the carrying out of logistical work surrounding the training and seminar programmes of the Hague Conference; helps establish an international panel of resource persons

(already many international experts are involved in the programmes); assists in the development of training materials; and drafts and implements funding proposals. Several important initiatives and programmes are already underway and envisaged under the aegis of the Centre.

1. The Intercountry Adoption T echnical

Assistance Programme (ICATAP) An Intercountry Adoption Technical Assistance Program (hereinafter “ICATAP”) was launched in 2007 to support the implementation of the Hague Convention of 29 May 1993 on Protection of Children and Cooperation in respect of Intercountry Adoption (1993 Hague Convention). The 1993 Hague Convention is the principal multilateral instrument to regulate intercountry adoption in detail, and it establishes safeguards to ensure that where intercountry adoptions take place they do so in the best interests of the child with respect for the child’s fundamental rights. There are 75 States Parties to the 1993 Hague Convention. In order for the 1993 Hague Convention to operate successfully, it is essential that the initial steps necessary for its effective implementation within each Contracting State be carefully planned. The Convention places heavy burdens of responsibility on both receiving States and States of origin, but in States of origin, implementation and technical assistance may be particularly vital in countries that have few resources available for this purpose. The States Parties to the Convention have entrusted the Secretariat of the Hague Conference (the Permanent et de formation en matière de mise en œuvre. In order to do so, the ICATAP, fi rst proposed in the 2002-2003 Supplementary Budget of the Hague Conference, and begun in 2007, is designed to provide assistance directly to the Governments of

The ICATAP is operated directly by the Permanent Bureau, utilising staff and resources dedicated to this project, as well as international consultants and experts. An initial grant by the Government of The Netherlands and subsequent support by the Governments of the United States of America and Australia assisted with the Implementation Assistance Programme staff and running costs for two pilot States (Guatemala and Kenya) until December 2008. There has been large interest in the programme, and the legal tools, frameworks and information developed during the pilot phase for Guatemala (for more information about the activities which are being carried on, please refer to page 25 of this issue of the Judges’ Newsletter). In relation to Kenya, initial discussions have been undertaken with the Offi ce of the Vice President and Ministry for Home Affairs, the Chief Justice of Kenya, and with UNICEF with a view to providing technical assistance, including legislative advice and work with the judiciary. A fi rst stakeholder discussion session and information session for the judiciary was to be convened in the near future, but due to the recent events in Kenya will have to be postponed. Furthermore, initial discussions in respect of providing technical assistance have been held with authorities in Cambodia (a Convention country), Malawi, Nepal and Vietnam (non-Convention countries). Further diffi culties have been identifi ed in Convention countries: Belarus, El Salvador, Costa Rica, and Thailand; and non-Convention countries: Ethiopia, Haiti, Indonesia, the Russian Federation and Ukraine. Specifi c requests

Les États parties à la Convention ont chargé le Secrétariat de la Conférence de La Haye (le Bureau Permanent) de suivre et d’examiner le fonctionnement de la Convention dans les différents États contractants et d’aider ces derniers à assurer une mise en œuvre et un fonctionnement effi caces. C’est à cette fi n que le programme ICATAP a été initialement proposé dans le budget supplémentaire 2002-2003 de la Conférence de La Haye. Engagé en 2007, il est conçu pour apporter une aide directe aux Gouvernements de certains États qui envisagent de ratifi er la Convention ou d’y adhérer ou qui l’ont ratifi ée ou y ont adhéré mais rencontrent des diffi cultés de mise en œuvre. La dotation initiale du Gouvernement des Pays-Bas et le fi nancement apporté ensuite par le Gouvernement des États-Unis d’Amérique et le Gouvernement de l’Australie ont contribué à couvrir les charges de personnel et de fonctionnement du programme pour deux États pilotes (Guatemala et Kenya) jusqu’en décembre 2008.
