Projet adopté Draft adopted 250[51RapportExplanatory Report byW.L.M. Reese Rapport explicatif deM. W.L.M. Reese(TRADUCTION DU BUREAU PERMANENT) A IntroductionThe law governing products liability was first suggestedas a possible subject for a convention of the HagueConference at the meeting of the Special Commissionon Torts in October 1967. This suggestion was approv-ed at the Eleventh Session of the Hague Conferencein October 1968. It was then determined that a draftconvention on products liability should be prepared bya Special Commission and that the topic should be oneof those considered at the Twelfth Session of the HagueConference in October 1972.
In implementation of this decision, the PermanentBureau in November 1969 sent the Member Govern-ments a document which contained (a) a questionnaireon what should be the scope of the convention and thenature of the applicable law and (b) a report on‘Products Liability in the Conflict of Laws’ by MrM. L. Saunders, who was at that time a member ofthe Permanent Bureau staff. The replies to the question-naire were assembled by the Permanent Bureau andsent to the Governments.A Special Commission was then organized. It held itsinitial meeting in The Hague from September 7-12,1970 at which time the general field was canvassed andbasic decisions made. At the second meeting of theCommission, held in The Hague during the period ofMarch 29-April 5, 1971, the decisions made at theinitial meeting were reviewed, and agreement reachedon the provisions of a draft convention. Mr G. vanHecke, Professor in the Faculty of Law of the Univer-sity of Leuven, presided as Chairman over both sessionsof the Special Commission. The undersigned served asRapporteur. The task of preparing a definitive Convention wasentrusted to the First Commission of the Twelfth Ses-sion of the Conference, which was likewise chaired byMr G. van Hecke. Mr W. Lorenz, Professor in theFaculty of Law of the University of Munich, servedas Vice-President and the undersigned again served asRapporteur. The draft convention that had previouslybeen prepared by the Special Commission and theObservations of the Governments on this Conventionserved as the basis of the discussions of the First Com-mission. The definitive Convention prepared by theFirst Commission and approved by the Twelfth Sessionof the Conference follows the general outline of thedraft convention but differs in several important res-pects.
25218] Reese Report Rapport ReeseB General discussion of the ConventionThe Convention is concerned exclusively with the lawgoverning products liability in situations where theperson claimed to be liable did not transfer the product,or the right to use the product, to the person suffer-ing damage. The Convention does not deal with judicialjurisdiction or with the recognition or enforcement offoreign judgments rendered in a products liability case. The Convention consists of 22 articles. Of these, thefirst three are concerned with the scope of the Conven-tion. Articles 4-6 are the most important provisionssince they state the rules for determining the applica-ble law. Article 7 limits the application of articles4-6 by providing that a defendant shall not be heldliable under an unforeseeable law, while article 9authorizes the court to give consideration ‘to the rulesof conduct and safety prevailing in the State wherethe product was introduced into the market’ as well asto the analogous rules prevailing in the State whoselaw is made applicable under articles 4-6. Article 8lists certain important issues governed by the law madeapplicable by the Convention, while article 10 containsthe customary provision on p
