Cette série contient la quasi-totalité des avant-projets, procès-verbaux, rap­ ports et documents de travail de la Quinzième session, les rapports des Commissions spéciales qui l'ont prépa­ rée ainsi que les études préliminaires effectuées par le Bureau Permanent. Sa forme et son contenu ont été déterminés par le souci de rendre accessibles à tout inté­ ressé - juge, professeur, avocat, notaire, personne pri­ vée ou administration nationale - les travaux qui ont conduit au projet de convention élaboré et de contribuer ainsi à une bonne compréhension du texte adopté et des motifs qui ont déterminé sa solution. Le présent tome contient tout d'abord des informations générales telles que la composition des délégations, puis les procès-verbaux des Séances d'ouverture et de clôtu­ re. On trouvera ensuite le texte complet de l'Acte final de la Quinzième session. La partie suivante comprend les documents préliminaires ainsi que les conclusions de la Commission spéciale de juin 1981 et de janvier 1984

A la fin du présent tome se trouve une bibliographie repre­ nant entièrement toutes les précédentes bibliographies éditées par la Conférence et enrichie des références aux ouvrages et articles nouveaux parus jusqu'au 31 décem­ bre 1985. Le projet de convention et les décisions ont été arrêtés en textes français et anglais équivalents. Conformément à la pratique habituelle, les interventions faites par les délégations lors des réunions ont été rendues en français ou en anglais selon la langue employée par l'orateur. Par contre tous les documents émanant du Secrétariat ont été diffusés dans les deux langues. L'importance à attribuer aux Actes et documents de la Conférence dépend dans une large mesure de la qualité des procès-verbaux. L'organisation des séances et la ré­ daction des comptes-rendus sont des activités qui exigent un grand dévouement et des connaissances approfondies des matières traitées. Nous savons gré à M. Michel Pelichet, secrétaire général adjoint de la Conférence et à MM. Dyer et van Loon pour y avoir mis de leur meil­ leur. This séries contains practically ail of the preliminary drafts, minutes, reports and working docu­ ments of the Fifteenth Session, the reports of the preparatory Spécial Commissions and the preliminary studies carried out by the Permanent Bureau. Its form and its content have been determined by the concern to render accessible to ail interested persons - judges, professors, lawyers, notariés, private individuals and national ad­ ministrations - the working materials which led to the draft Convention which has been prepared and to contribute to better compréhension of the text adopted and of the thinking which determined its solution. This first book includes at the start gênerai information, such as the membership of the délégations and then the minutes of the Opening and Closing Sessions. The com­ plète text of the Final Act of the Fifteenth Session apDears thereafter. The subséquent part includes the preiminary documents for and the conclusions of the Spé­ cial Commissions of June 1981 and January 1984 on gên­ erai matters and policy of the Conférence, as well as the preparatory documents, minutes and working docu­ ments of the First Commission, which dealt with thèse questions at the Plenary Session. At the end of this book will be found a bibliography entirely incorporating ail of the preceding bibliographies edited by the Conférence,

The draft Convention and the décisions have been set out in équivalent English and French texts. In accordance with the usual practice, the remarks made by del- êgates during the meetings were rendered in French or in English depending on the language employed by the speaker. On the other hand, ail the documents emanating from the Secrétariat were drawn up in both languages. The importance to be assigned to the Proceedings of the Conférence dépends in large measure on the quality of the minutes. The organization of the sessions and editing of thèse accounts are activities which require very great dévotion and profound understanding of the subjects under discussion. We are most grateful to Mr Michel Pelichet, Deputy Secretary General of the Conférence, and to Messrs Dyer and van Loon for having put their hearts into their work. The names of the recording secretaries who reinforced the Secrétariat appear in the Ust of members of the Bureau set down in the first part. F. van Eekelen prononce le discours sui­ vant: Your Excellencies, Ladies and Gentlemen, I am honoured and delighted to welcome you in the name of the Government of the Kingdom of the Netherlands to the Fifteenth Session of the Hague Conférence on Private International Law. Since the last Session, the Conférence, which has been meeting in The Hague since 1893, has passed its 90th year of existence and is headed towards the vénérable âge of one century. Much progress has been made in the development of private inter­ national law since the legendary Tobias Asser was installed as Président of that First Session, the first of four Sessions over which he was to préside before being awarded the Nobel Peace Prize in 1911. In spite of long periods of time when international co-operation in our field had broken down, the aspiration to promote doser international relationships through the unification of rules of private international law has revived and has led

In spite of long periods of time when international co-operation in our field had broken down, the aspiration to promote doser international relationships through the unification of rules of private international law has revived and has led to the Seventh Session of the Conférence in 1951. That aspiration has resulted in the création of the Permanent Bureau of the Conférence, which is now in its 30th year of opération. The achievements of the Conference's aims for the prog­ ressive unification of the rules of private international law are reflected in the well-known pamphlet édition of the Collection of Hague Conventions, which changes colour after each Session with the addition of newly adopted texts; the only instance where the image of the chameleon can be used in a_favourable manner in describing légal articles. If the Fifteenth Session is successful in its quest for an agreed text on the subject of trusts, the next édition will contain 30 Conventions, ail of which represents remarkable progress in the Confer­ ence's activities during the last three décades. Of course we ail know that it will not be an easy task to gain more récognition of the trust - an Anglo-Saxon institutionin countries outside the common law world. However, as the English poet Rudyard Kipling said: 'Gardens are not made by singing "Oh, how beautiful", and sitting in the shade'. I do realize that a great deal of work is required on your part in the next two weeks and I wish you success in everything. I sincerely hope that at the end of this Session the 'Convention on the Law Appli­ cable to Trusts and on their Récognition' will be added to the list of Hague Conventions. I have been told that unlike previous Sessions, this Fif­ teenth Session will only be two weeks with only one Convention to establish. The reason behind this lies in the opening of the Hague Conférence to non-Member States for the revision of the 1955 Convention on the Law Applicable to International Sales of Goods during an Extraordinary Session to be held in October 1985. The préparations for this Extraordinary Session have now proceeded well through two Spécial Commission meetings in which ail the Members of the United Na­ tions Commission on International Trade Law were invited to participate. The participation was supported by recommendations adopted by UNCITRAL and by the General Assembly of the United Nations Organization. This is a notable example of constructive co-operation among inter-governmental organizations with a view to efficacy and to the avoidance of overlapping work. I sincerely
