Le tome II - Successions, loi applicable contient tous les documents concernant l'élaboration de la Convention sur la loi applicable aux successions à cause de mort. Le présent tome coritient tout d'abord des informations générales telles que la composition des délégations, puis es procès-verbaux des Séances d'ouverture et de clôtu­ re. On trouvera ensuite le texte complet de l'Acte final de la Seizième session. La partie suivante comprend les documents préliminaires, les conclusions de la Commis­ sion spéciale de janvier 1988 sur les affaires générales et la politique de la Conférence ainsi que les documents préparatoires, documents de travail et procès-verbaux de la Première commission qui s'est occupée de ces questions à la Session plénière. A la fin du présent tome se trouve une bibliographie reprenant entièrement toutes les précédentes bibliographies éditées par la Conférence et enrichie des références aux ouvrages et

questions à la Session plénière. A la fin du présent tome se trouve une bibliographie reprenant entièrement toutes les précédentes bibliographies éditées par la Conférence et enrichie des références aux ouvrages et articles nouveaux parus jusqu'au 15 juillet 1991. Le projet de convention et les décisions ont été arrêtés en textes français et anglais équivalents. Conformément à la pratique habituelle, les interventions faites par les délégations lors des réunions ont été rendues en français ou en anglais selon la langue employée par l'orateur. Par contre tous les documents émanant du Secrétariat ont été diffusés dans les deux langues. L'organisation des séances et la rédaction des docu­ ments préliminaires sont des activités qui exigent un grand soin et des connaissances approfondies des matiè­ res traitées. Nous savons gré à M. Michel Pelichet, se­ crétaire général adjoint de la Conférence et à MM. Dyer et Van Loon, premiers secrétaires au Bureau Permanent pour y avoir mis de leur meilleur. Quant aux procès-ver­ baux les noms des secrétaires-rédacteurs responsables de leur rédaction figurent dans la composition du Bu­ reau reproduite ci-après. Il arrive souvent que ces jeunes spécialistes accèdent à des postes importants dans leur pays et se retrouvent parmi les délégations. L'édition de ces Actes et documents a été à nouveau assurée par Mme Françoise Franck, assistée de Mme Gerda Boerman. La qualité de la composition et de la typographie témoigne de leur expérience et de leur mi­ nutie. This publication is the first in a séries of two books entitled Proceedings of the Sixteenth Session (1988). Tome II - Succession to estâtes - applicable law contains ail the documents concerning the drafting of the Con­ vention on the law applicable to succession to the estâtes of deceased persons. The first book includes at the start gênerai information, such as the membership of the délégations and then the minutes of the Opening and Closing Sessions. The com­ plète text of the Final Act of the Sixteenth Session apjears thereafter. The subséquent part includes the preiminary documents for and the conclusions of the Spé­ cial Commission of January 1988 on gênerai matters and policy of the Conférence, as well as the preparatory documents, working documents and minutes of the First Commission, which dealt with thèse questions at the Plenary Session. At the end of this book will be found a bibliography entirely incorporating ail of the preceding bibhographies edited by the Conférence, enriched by références to new works and articles which have appeared up to 15 July 1991. The draft Convention and the décisions have been set out in équivalent English and French texts. In accordance with the usual practice, the remarks made by delegates during the meetings were rendered in French or English depending on the language employed by the speaker. On the other hand, ail the documents emanating from the Secrétariat were drawn up in both languages. The organization of the sessions and drafting of thèse preliminary documents are activities which require great care and profound understanding of the subjects under discussion. Jacobs prononce le discours suivant: Your Excellencies, Ladies and Gentlemen, It is a great privilège and an equally great pleasure for me to welcome you ail on behalf of the Netherlands Government to the Sixteenth Session of the Hague Con­ férence on Private International Law. The Conférence last met in 1985, in an Extraordinary Session devoted to the revision of the Convention on the Law Applicable to International Sales of Goods. In addition to Member States, the Netherlands Govern­ ment was able to invite to that Session the other States with which the Kingdom of the Netherlands maintains diplomatie relations. The number of States which accepted the invitation proved once again the correctness of the resolution passed at the Fourteenth Session of the 14 Séance d'ouverturelOpening Session Conférence that 'non-Members may participate in the work of the Conférence where, by virtue of the subject treated, it is felt that such participation is necessary'. The success of the Extraordinary Session indicates the importance attached ail over the world to the unification of private international law, while at the same time it can be seen as a mark of esteem for the work of the Hague Conférence and the Conventions it has drawn up. For the Sixteenth Session we are back in the closed circle of Members. I should like to put that remark in perspective, however, as I am pleased to note that the number of Member States continues to increase. Since the last ordinary session in October 1984, the number has risen to 36 with the accession of Chile, Mexico, Hungary and China. It is not only in geographical terms that the purview of the Conférence is undergoing a steady expansion. In this connection I need only refer to the impressive list of Conventions drawn up by the Conférence since the very

In this connection I need only refer to the impressive list of Conventions drawn up by the Conférence since the very first session in 1893. However, the fact that the quality of the product - if I may call it so - is still regarded as more important than the quantity, is obvions from the agenda before us today. The Sixteenth Session is to be devoted chiefly to the draft Convention on the law applicable to succession to the estâtes of deceased per­ sons. And, as past expérience has taught us, interna­ tional inheritance law is a subject of such complexity that we are fuUy justified in confining ourselves to that topic alone. Nonetheless, I trust that over the next few weeks your expertise and your hard work will ensure that yet another Hague Convention sees the light of day. I should like to take this opportunity of wishing you every success in your endeavours. A glance at the Conclusions of the Spécial Commission of January 1988 on gênerai affairs and policy of the Con­ férence shows that the field in which the Hague Confér­ ence Works, i.e. the codification of private international law, is not yet completely under cultivation. The number and diversity of subjects listed in the Conclu­ sions for future considération by the Conférence show that the end of the harvest is still a long way off. How­ ever, I believe that the Conférence has shown that it can muster the proper tools for the job. Both now and in the future you will undoubtedly be able to count on the support of Monsieur Droz, the Secretary General of the Conférence, and his expert staff. The Netherlands Government therefore recognizes that the Bureau needs new premises. At this point I should hke to say that the Netherlands Government will do everything within its power to assist the Secretary Gen­ eral to obtain thèse new premises. On the eve of the centenary of the Hague Conférence - and you will be taking the first steps towards planning the célébrations at this session - the conclusion is unavoidable that the Conférence is still bursting with vitality and that it looks forward to the future with youthful vigour.
