Notice to the reader

La présente publication est la première d’une série de trois tomes intitulés Actes et documents de la Vingt et unième session. Cette série contient l’ensemble des procès-verbaux et documents de travail de la Vingt et unième session de la HCCH ainsi que les documents pertinents des Commissions spéciales préparatoires et des études préliminaires réalisées par le Bureau Permanent. Sa forme et son contenu ont été déterminés par le souci de rendre accessibles à tout intéres-sé – juge, professeur, avocat, personne privée ou adminis-tration nationale – les travaux qui ont conduit à la Conven-tion du 23 novembre 2007 sur le recouvrement internatio-nal des aliments destinés aux enfants et à d’autres membres de la famille et au Protocole du 23 novembre 2007 sur la loi applicable aux obligations alimentaires, dans le but de contribuer à une bonne compréhension des textes adoptés et des motifs qui ont déterminé les solutions consacrées dans la Convention et le Protocole. Ce premier tome, qui se divise en deux volumes, ne com-prend que les documents directement liés au texte final de la Convention HCCH de 2007 sur le recouvrement des ali-ments. Les documents concernant le Protocole HCCH de 2007 sur les obligations alimentaires sont publiés dans le tome II des Actes et documents de la Vingt et unième ses-sion. Ce dernier tome et le tome III concernant les matières diverses sont réunis dans un seul volume.

En ce qui concerne le tome III, il convient de noter que jusqu’en 2005, le Conseil sur les affaires générales et la politique (CAGP) se réunissait en tant que Commission de la Session diplomatique et donc, en principe, tous les quatre ans. À la suite de la révision du Statut de la HCCH en 2005, le CAGP se tient, en principe, chaque année. La Vingt et unième session a donc été la première Session diplomatique à ne pas avoir inclus une Commission distincte sur les af-faires générales et la politique. Les documents prélimi-naires préparés à l’attention du CAGP entre 2005 et 2007 ne sont donc pas inclus dans les Actes et documents de la Vingt et unième session mais sont disponibles sur le site web de la HCCH (<www.hcch.net>), de même que tous les documents relatifs aux réunions annuelles du CAGP qui ont eu lieu entre les Vingt et unième et Vingt-deuxième ses-sions. Tous les autres documents divers relatifs à la Vingt et unième session sont rassemblés dans le tome III. Le présent tome comprend les documents de travail et les procès-verbaux de la Commission I, chargée de travailler sur la Convention HCCH de 2007 sur le recouvrement des aliments lors de la Session diplomatique de novembre 2007. Il contient également le texte final adopté de la Con-vention, ainsi que le Rapport explicatif préparé par Alegría Borrás et Jennifer Degeling avec l’aide de William Duncan et Philippe Lortie.

This publication is the first in a series of three Tomes enti-tled Proceedings of the Twenty-First Session. This series contains all the minutes and working documents of the Twenty-First Session of the HCCH as well as relevant doc-uments from the preparatory Special Commissions and the preliminary studies carried out by the Permanent Bureau. Its form and its content have been determined by the con-cern to render accessible to all interested persons – judges, professors, lawyers, private individuals, and national ad-ministrations – the working materials which led to the Con-vention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance and the Protocol of 23 November 2007 on the Law Appli-cable to Maintenance Obligations, with the aim of contrib-uting to better comprehension of the texts adopted and the thinking that determined which solutions were to be em-bodied in the Convention and Protocol. This first Tome, which is divided into two volumes, en-compasses only the documents directly related to the final text of the HCCH 2007 Convention on Child Support. The documents concerning the HCCH 2007 Protocol on Mainte-nance Obligations are published in Tome II of the Proceed-ings of the Twenty-First Session. Tome II and Tome III concerning Miscellaneous matters are combined in a single volume. With regard to Tome III, it is important to note that until 2005, the Council on General Affairs and Policy (CGAP) met as a Commission of the Diplomatic Session and so, in principle, met every four years. Following the revision of the HCCH Statute in 2005, CGAP has been held, in principle, annually. The Twenty-First Session was therefore the first Diplomatic Session that did not include a separate Com-mission on General Affairs and Policy. Preliminary Docu-ments prepared for the attention of CGAP between 2005 and 2007 are consequently not included in the Proceedings of the Twenty-First Session but are available on the HCCH

website (<www.hcch.net>), as are all documents related to the annual CGAP meetings that were held between the Twenty-First and Twenty-Second Sessions. All other mis-cellaneous documents relevant to the Twenty-First Session are collected in Tome III. The present Tome includes the working documents and minutes of Commission I, charged with work on the HCCH 2007 Convention on Child Support during the Diplomatic Session of November 2007. It also contains the final adopt-ed text of the Convention, as well as the Explanatory Re-port drawn up by Alegría Borrás and Jennifer Degeling with the assistance of William Duncan and Philippe Lortie.I-6 Avis au lecteur Notice to the reader La HCCH est une organisation bilingue dont les langues officielles sont l’anglais et le français. I N T R O D U C T I O N 1 Dans l’Acte final de la Dix-huitième session, la Con-férence de La Haye de droit international privé a chargé le Secrétaire général : « a de convoquer, avant la Dix-neuvième session, une Commission spéciale chargée d’examiner le fonc-tionnement des Conventions de La Haye sur les obliga-tions alimentaires et de la Convention de New York du 20 juin 1956 sur le recouvrement des aliments à l’étranger et, à l’occasion de cette réunion, d’examiner l’op-portunité de reviser ces Conventions de La Haye et l’inclusion dans un nouvel instrument de dispositions sur la coopération judiciaire et administrative ; b de tenir à jour la liste des autorités prévues par la Convention de New York de 1956 et de communiquer, au rythme d’une ou deux fois par année, cette liste à toutes ces autorités dans les États membres de la Con-férence de La Haye ; c de convoquer un groupe de travail informel chargé d’établir un projet de formules modèles destinées à ac-compagner les dossiers et à assurer l’accusé de récep-tion de ceux-ci dans l’application de la Convention de New York de 1956, ces projets de formules devant être examinés et éventuellement adoptés lors de la pro-chaine Commission spéciale sur le fonctionnement des Conventions en matière d’obligations alimentaires. »1

2 Cette Décision a été prise à la suite de l’examen des Recommandations de la Commission spéciale de novembre 1995 sur le fonctionnement des Conventions de La Haye relatives aux obligations alimentaires et de la Convention de New York du 20 juin 1956 sur le recouvrement des ali-ments à l’étranger, selon lesquelles le Secrétaire général devait a) convoquer régulièrement, à un rythme d’une réu-nion tous les quatre ou cinq ans, une Commission spéciale chargée d’examiner le fonctionnement desdites Conven-tions et b) tenir à jour la liste des autorités prévues par la Convention de New York de 19562. Toutefois, la décision de s’interroger sur l’opportunité de reviser les Conventions de La Haye et l’inclusion dans un nouvel instrument de dispositions sur la coopération judiciaire et administrative n’a pas pour origine une recommandation de la Commis-sion spéciale de 1995. 3 La Commission spéciale de novembre 1995 a, à partir d’une Note sur le fonctionnement des Conventions de La Haye relatives aux obligations alimentaires et de la Con-vention de New York de 1956, établie par Michel Pelichet3, examiné en détail un grand nombre de problèmes pratiques concernant le fonctionnement des quatre Conventions de La Haye et de la Convention de New York.
