Voici plus d’un siècle que la Conférence documente abondamment ses travaux, notamment par les Actes et documents, et rend compte de ses activités à ses organes directeurs. Toutefois, cent-quinze ans après la Première session de la Conférence, en septembre 1893, le temps est venu de présenter au monde un Rapport annuel des activités variées de l’Organisation sous une forme synthétique. L’une des raisons de cette nouvelle publication tient à la révision du Statut de la Conférence, entrée en vigueur le premier janvier 2007. Le poids croissant pris par l’Organisation dans un contexte de mondialisation et d’intégration régionale en constitue une autre.

La révision du Statut était devenue nécessaire pour permettre aux Organisations régionales d’intégration économique de devenir Membre de la Conférence. Le Rapport annuel rend ainsi compte de la cérémonie du 3 avril 2007 par laquelle la Communauté européenne a accepté le nouveau Statut. La révision du Statut a en outre introduit un changement formel dans la structure institutionnelle de la Conférence, confirmant ainsi le rôle du « Conseil sur les affaires générales et la politique (…), composé de tous les Membres » pour assurer le fonctionnement de la Conférence. Nous espérons que le Rapport annuel s’avérera utile aux Membres notamment à l’occasion de la réunion annuelle du Conseil. En dernier ressort, ce sont les citoyens des Membres, et finalement les citoyens du monde entier, qui bénéficient du travail de la Conférence. Le nombre de personnes et de sociétés engagées dans des relations internationales ou transfrontalières ne cesse d’augmenter. Les Conventions de La Haye et les services qui y sont liés, fournis par la Conférence, sont de plus en plus nécessaires pour faciliter ces activités, protéger les plus vulnérables et promouvoir coordination et coopération par-delà les frontières. Au-delà des Membres de la Conférence, le Rapport annuel s’adresse aux citoyens du monde entier, pour leur faire connaître la contribution de la Conférence à la mise en place et au bon fonctionnement d’une infrastructure juridique pour notre société globale.

La Convention sur le recouvrement international des aliments destinés aux enfants et à d’autres membres de la famille, et son Protocole sur la loi applicable aux obligations alimentaires, adoptés tous deux par la XXIème session en novembre 2007 constituent d’excellents exemples d’une telle infrastructure. Le nombre des Membres de la Conférence et la portée des traités multilatéraux ou Conventions de La Haye – 130 États sont aujourd’hui Membres ou Parties à au moins une des Conventions – ne cessent de croître. En outre, le besoin d’assistance dans la mise en œuvre et l’application des Conventions augmente en parallèle, notamment dans les pays émergeants. L’année 2007 a vu la mise en place, au sein du Bureau Permanent, du Centre international d’études judiciaires et d’assistance technique de la Conférence. Dès sa première année, le Centre – qui repose entièrement sur des financements volontaires – a fait la preuve de son potentiel en apportant à plusieurs pays une aide à la mise en œuvre des Conventions de La Haye en matière de protection des enfants et de coopération administrative et judiciaire. La mission de la Conférence de La Haye est très particulière. Nous espérons que ce Rapport annuel contribuera à la faire mieux connaître et à renforcer l’enthousiasme, la bonne volonté et le soutien dont son succès dépend. Welcome to this first Annual Report of the Hague Conference on Private International Law! For over a century the Hague Conference has thoroughly documented its work, in particular through its Proceedings, the Actes et documents, and has reported to its governing bodies. Now, 115 years on from the First Session of the Conference in September 1893, however, the time has come to present to the world an Annual Report on the Organisation’s various activities in magazine form. One reason prompting this new publication is the revision of the Conference’s Statute, which entered into force on 1 January 2007; another, the continually rising profile of the Organisation in an age of globalisation and regional integration. The revision of the Statute was necessary to enable Regional Economic Integration Organisations to join the Hague Conference. This Annual Report covers the ceremony of the accession of the European Community to the new Statute which took place on 3 April 2007. The revision of the Statute also brought about a formal change in the Conference’s governing structure, confirming the role of the “Council on General Affairs and Policy (…), composed of all Members” as being in “charge of the operation of the Conference”. It is hoped that the Annual Report will assist Members, in particular on the occasion of the annual meeting of the Council. The ultimate beneficiaries of the Conference’s work are the Members’, and indeed the world’s, citizens. In ever growing numbers, individuals and companies are engaged in transnational transactions and relationships. Increasingly, the Hague Conventions, and the related services provided by the Conference, are needed to facilitate these activities, protect the vulnerable, and promote co-ordination and co-operation across borders. The Annual Report, beyond the Conference’s Members, reaches out to the world’s citizens to inform them of the Conference’s contribution to the establishment and good functioning of a legal infrastructure for our globalising world society. The reach of the Conference’s Members and of the Hague multilateral treaties or Conventions continues to expand – 130 States are now either Members or Parties to a Convention. At the same time, the need for assistance in the implementation and application of the Conventions also increases, in particular in developing countries. The year 2007 saw the establishment, within the Permanent Bureau, of the Conference’s International Centre for Judicial Studies and Technical Assistance. Already in its first year, the Centre – which is entirely dependent on voluntary funding – has demonstrated its potential by providing help to several countries in the implementation of Hague Conventions on child protection and legal co-operation. The Hague Conference has a very special mission. May this Annual Report assist in making this mission better known and in reinforcing the enthusiasm, the goodwill and support upon which its success depends. Le Statut d’origine, en vigueur depuis le 15 juillet 1955, ne lui permettait d’accueillir que des États. Les amendements, adoptés le 30 juin 2005 et approuvés par les États membres le 30 septembre 2006, avaient un double objectif : tout d’abord permettre à des Organisations régionales d’intégration économique de rejoindre la Conférence, mais aussi adapter le Statut aux développements institutionnels des dernières décennies. Ces amendements ont permis d’accueillir la Communauté européenne au sein de la Conférence. Cette adhésion, qui avait été demandée en décembre 2002, a été concrétisée le 3 avril 2007 par le dépôt de l’instrument d’acceptation du Statut, lors d’une cérémonie organisée à l’occasion de la réunion du Conseil sur les affaires générales et la politique.

La Ministre allemande de la Justice, Madame Brigitte Zypries, qui représentait la Présidence du Conseil de l’Union européenne, a remis l’instrument au dépositaire du Statut, le Ministère des Affaires étrangères du Royaume des Pays-Bas. À l’occasion du dépôt de son instrument d’acceptation du Statut, la Communauté européenne a également déposé une déclaration de compétence de la Communauté européenne en matière de droit international privé, et fait l’importante déclaration suivante : « La Communauté européenne s’efforce d’examiner s’il est dans son intérêt d’adhérer aux Conventions de La Haye existantes qui relèvent de la compétence de la Communauté. Lorsque cet intérêt existe, la Communauté européenne, en coopération avec la Conférence de La Haye, produira tous les efforts nécessaires pour surmonter les difficultés résultant de l’absence de clause permettant l’adhésion d’une Organisation régionale d’intégration économique à ces conventions. La Communauté européenne s’efforce de rendre possible la participation de représentants du Bureau Permanent de la Conférence aux réunions d’experts organisées par la Commission européenne lorsque les sujets discutés intéressent la Conférence. » Conseil sur les affaires générales et la politique Le Conseil sur les affaires générales et la politique s’est réuni du 2 au 4 avril 2007 dans les nouveaux locaux de l’Académie, dans l’enceinte du Palais de la Paix, sous la présidence de

M. Antti Leinonen, expert de la Finlande. Le Conseil a accepté par consensus la demande

d’adhésion de la Communauté européenne à la Conférence et, après le dépôt de l’instrument d’adhésion, a souhaité la bienvenue à la Communauté européenne. Le Conseil a également pris des décisions relatives aux travaux futurs et a exprimé son soutien aux efforts continus du Bureau Permanent en faveur de l’utilisation et du développement des systèmes informatiques, ainsi qu’au large éventail d’activités postérieures aux Conventions conduites par le Bureau Permanent. The original Statute, which entered into force on 15 July 1955, only provided for membership of States. The primary purpose of the amendments adopted on 30 June 2005 and approved by the Member States on 30 September 2006 was to enable Regional Economic

Integration Organisations to join the Hague Conference. In addition, some amendments were made to adapt the Statute to institutional developments that had occurred over the past decades. The amendments paved the way for the accession of the European Community to the Hague Conference, for which the European Community had applied in December 2002. This accession took place on 3 April 2007 during a ceremony on the occasion of the meeting of the Council on General Affairs and Policy through the deposit of the instrument of acceptance of the Statute. The acting President of the Council of the European Union, the German Minister of Justice, Madam Brigitte Zypries deposited the instrument with the Statute’s depositary, the Ministry of Foreign Affairs of the Kingdom of the Netherlands. On the occasion of the deposit of its instrument of acceptance of the Statute, the European Community also deposited a declaration of competence of the European Community in the field of private international law, as well as the following important declaration: “The European Community endeavours to examine whether it is in its interest to join existing Hague Conventions in respect of which there is Community competence. Where this interest exists, the European Community, in co-operation with the HCCH, will make every effort to overcome the difficulties resulting from the absence of a clause providing for the accession of a Regional Economic Integration Organisation to those Conventions. The European Community further endeavours to make it possible for representatives of the Permanent Bureau of the HCCH to take part in meetings of experts organised by the Commission of the European Communities where matters of interest to the HCCH are being discussed.” Council on General Affairs and Policy The Council on General Affairs and Policy met from 2 to 4 April 2007 in the new Academy Building on the grounds of the Peace Palace, under the chairmanship of Mr Antti Leinonen, expert from Finland. The Council accepted by consensus the European Community’s application for membership of the Hague Conference and, following the deposit of the

instrument of accession, welcomed the European Community as a Member of the Organisation. The Council also made decisions relating to future work and expressed its support for the continued efforts of the Permanent Bureau in relation to the use and the development of information technology systems, and the broad range of post-Convention activities currently being carried out by the Permanent Bureau. M. Alfons H.M. Stoelinga, Secrétaire général adjoint du Ministère des Affaires étrangères du Royaume des Pays-Bas. Le Conseil a approuvé les comptes de l’Exercice financier LI

(le premier juillet 2005 – 30 juin 2006) soumis par le Secrétaire général de la Conférence. Il a également examiné et approuvé le projet de budget de l’Exercice financier LIII (le premier juillet 2007 – 30 juin 2008), et examiné le Budget supplémentaire, financé par des contributions volontaires, de l’Exercice financier LIII. Bureau Permanent Mme Andrea Schulz a quitté son poste de Premier secrétaire de la Conférence de La Haye le

premier juillet 2007. La Conférence remercie Mme Schulz pour le dévouement dont elle a fait preuve pendant plus de cinq ans et plus particulièrement pour ses remarquables réalisations en tant que juriste ayant la responsabilité première des travaux préparatoires de la Convention de 2005 sur les accords d’élection de for ainsi que pour ses nombreuses et importantes contributions aux travaux sur les Conventions relatives aux enfants. Mme Schulz restera chargée de certaines missions pour le Bureau Permanent après son départ et poursuivra, en particulier, les travaux préparatoires du chapitre « Exécution des décisions » du Guide de bonnes pratiques en vertu de la Convention de 1980 sur l’enlèvement d’enfants. La procédure de recrutement de son successeur a abouti fin 2007 à la nomination de Mme Marta Pertegás en qualité de Secrétaire. De nationalité espagnole, Mme Pertegás enseigne le droit international privé à l’Université d’Anvers (Belgique)2. En 2007, Mmes Laura Martínez-Mora et Sophie Molina ont été recrutées respectivement en qualité de coordinatrice et d’assistante administrative pour le Programme d’assistance technique en matière d’adoption internationale (ICATAP), qui est financé par le Budget supplémentaire. Le 31 décembre 2007, le personnel du Bureau Permanent représentait 23,4 « équivalents temps plein » financés par le Budget régulier, originaires de 14 pays dans le monde entier. Le Bureau Permanent a également accueilli en 2007 plusieurs stagiaires et fonctionnaires détachés venus d’Allemagne, d’Australie (Programme de stages Peter Nygh), du Canada

Au cours de l’année 2007, divers projets de recherche ont été engagés ou menés à terme, notamment avec la Cardiff Law School et l’Université de Dundee (Royaume-Uni). Le Bureau Permanent coopère de façon suivie avec les Facultés de droit des Universités de Groningue (Pays-Bas), Tohoku (Japon) et Lyon (Université Jean Moulin, France). Stoelinga, Deputy Secretary General on behalf of the Minister of Foreign Affairs of the Kingdom of the Netherlands. The Council approved the accounts submitted by the Secretary General of the Hague Conference for Financial Year LI (1 July 2005 – 30 June 2006) and discussed and approved the draft Budget for Financial Year LIII (1 July 2007 – 30 June 2008). Permanent Bureau Ms Andrea Schulz left her position as First Secretary of the Hague Conference as of 1 July 2007. The Hague Conference is grateful to Ms Schulz for her dedication for over five years and, in particular, her outstanding accomplishments as the legal staff member with primary responsibility for the preparation of the 2005 Choice of Court Convention, as well as her many significant contributions to the work on the Hague Children’s Conventions. Ms Schulz will continue to carry out certain missions for the Permanent Bureau despite her departure. In particular, she will continue to be involved in the preparation of the Guide to Good Practice on the enforcement of orders made under the 1980 Child Abduction Convention. The procedure for the recruitment of her successor was launched in 2007 and completed at the end of the year with the appointment of Marta Pertegás as Secretary. Ms Pertegás is a Spanish citizen who teaches Private International Law at the University of Antwerp (Belgium).2 In 2007 Ms Laura Martínez-Mora and Ms Sophie Molina were recruited respectively as Programme Co-ordinator and Administrative Assistant for the Intercountry Adoption Technical Assistance Programme (ICATAP), established on the basis of supplementary funds. At 31 December 2007 the Permanent Bureau consisted of 23.4 Full-Time Equivalent staff members funded through the Regular Budget, from 14 different countries around the world. The Permanent Bureau also welcomed in 2007 several interns and officials on secondment from the following countries: Australia (Peter Nygh Internship Programme), Canada (McGill University, Montreal and a State official from Quebec), France, Germany, Morocco, Uganda and the United States of America (New York University School of Law and Georgetown University).

In the course of the year 2007, different research projects were undertaken and / or completed, in particular with Cardiff Law School and the University of Dundee (both located in the United Kingdom). The Permanent Bureau maintains ongoing co-operation with the Faculté de droit, Université Jean Moulin in Lyon (France), the Law Faculty of the University of Groningen (Netherlands) and the Tohoku University School of Law (Japan). Les Ministres des Affaires étrangères, S.E. M. Maxime Verhagen, et de la Justice, S.E. M. Ernst Hirsch Ballin, du Royaume des Pays-Bas, les ambassadeurs des États membres et des représentants d’autres organisations internationales à La Haye ont assisté à la cérémonie d’ouverture, le 5 novembre 2007. La Session était présidée par M. A.V.M. (Teun) Struycken, Président de la Commission d’État néerlandaise de droit international privé. Deux Commissions conduisaient les négociations : la Commission I, présidée par Mme Mária Kurucz (Hongrie), a préparé le texte de la Convention, et la Commission II, présidée par M. Andrea Bonomi (Suisse) celui du Protocole.

Le 23 novembre 2007, la Session a adopté la Convention sur le recouvrement international des aliments destinés aux enfants et à d’autres membres de la famille et le Protocole sur la loi applicable aux obligations alimentaires. Elle a également adopté diverses Recommandations relatives au suivi de ces instruments. La Convention a été signée le jour même par les États-Unis d’Amérique.
