Avant-propos Selon une idée encore très répandue, le droit international public et le droit international privé sont aux antipodes l’un de l’autre. D’un côté, le droit international public, « centré sur l’État », régit les droits et obligations des États à l’égard des autres États et des individus, de l’autre, le droit international privé, centré sur les personnes, leurs relations et leurs transactions, règle les questions de compétence des juridictions nationales, de loi applicable et d’exécution des jugements. Mais en réalité, ces deux disciplines sont interconnectées, le droit international privé faisant partie intégrante du système juridique international et jouant à ce titre un rôle de plus en plus critique, tant en théorie qu’en pratique. Les travaux de la Conférence de La Haye illustrent clairement cette confluence. L’expansion mondiale des Conventions de La Haye remet en question l’idée que le droit international privé est par nature interne, et non international, tant il est vrai qu’elles influencent les législateurs et les juridictions des États, même lorsqu’ils ne sont pas formellement liés par elles. Cette expansion tient au besoin croissant, au sein de la communauté mondiale, d’établir un ordre international dans le contexte

Les travaux réalisés en 2010 répondent à ce double besoin. Le nouveau projet engagé en vue de l’élaboration de principes applicables au choix de la loi dans les contrats commerciaux internationaux vise en effet à répondre à la nécessité constatée d’une harmonisation de la diversité juridique. L’un des grands objectifs de ce projet est que partout au monde, les parties se voient reconnaître la liberté de choisir la loi qui doit gouverner leurs relations juridiques, une idée nouvelle pour un certain nombre de systèmes juridiques émergents. La Commission spéciale qui s’est réunie en juin 2010 pour examiner le fonctionnement pratique de la Convention de La Haye sur la protection des enfants et la coopération en matière d’adoption internationale de 1993 a clarifié plusieurs questions qui se sont posées au fil des ans autour de sa signification et de son application. Elle a ainsi conforté l’ordre mondial que la Convention, avec plus de 80 États parties, vise à établir, notamment en instaurant des normes mondiales en matière de droits humains. Cette réunion – la plus importante de l’histoire de la Conférence avec 250 participants – a également renforcé la coopération entre tous les acteurs responsables du fonctionnement de la Convention. Foreword According to a still widespread view, public international law and private international law are worlds apart. Public international law is ‘State-centred’ and deals with the rights and duties of States with respect to other States and individuals. Private international law is focused on people, their relations and transactions, and is concerned with issues of jurisdiction of domestic courts, applicable law and enforcement of judgments. In reality however, the two disciplines are interconnected, with private international law playing an increasingly critical role as an intrinsic part of the international legal system. This is true as much in theory as it is in practice. The work of the Hague Conference provides a clear illustration of this confluence. The global expansion of Hague Conventions challenges the notion that private international law is national law, not international law. Indeed, they influence legislators and courts of States even if they are not formally bound by them. Underlying this expansion is the world community’s increasing need for global ordering in the context of private and commercial law, and for the creation and nurturing of global networks for transnational direct communication and co-operation between authorities and judges. The work carried out in 2010 offers examples of both of the latter. Work started and progressed on a new project which aims to meet an identified global need to harmonise legal diversity: principles on the choice of law in international commercial contracts. A major aim is to achieve world-wide respect for the freedom of business parties to agree on the law that should govern their legal relationship, an idea which is new to a number of emerging legal systems. The Special Commission convened in June 2010 to review the practical operation of the 1993 Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption clarified several issues that have arisen concerning the meaning and application of the Convention. It thus reinforced the global ordering which the Convention, with over 80 States Parties, aims to achieve, in part by setting global human rights standards. The meeting – with over 250 participants, the largest held in the Conference’s history – also reinforced co-operation between all actors responsible for the Convention’s operation. The Conference’s activities in support of this global ordering work at the regional level further expanded in 2010. The e-APP Programme received a boost in Europe through EU funding. The Latin American programme on several Conventions further expanded, including through the development of international and national (e.g. Mexico) judicial networks. States of both southern and northern Africa became engaged in examining the relevance of the Hague Child Protection Conventions, and the growing interest of the Asia-Pacific region was illustrated by the Philippines becoming a Member of the Conference in July 2010. Much of the increasing attention given to Hague Conventions comes from emerging States. Requests for technical assistance have grown exponentially, including from some of the most disadvantaged countries on earth (e.g. Haiti’s request for assistance with the 1993 Convention). Assistance provided by the Hague Conference is in the common interest, and much of it touches on the protection of fundamental rights. The effective global ordering of legal diversity and development of co-operation between judges and officials world-wide is a growing must of the international legal system. Antti Leinonen, expert de la Finlande. Le Conseil a assisté à la signature et à la ratification (acceptation) par l’Union européenne du Protocole de 2007 sur la loi applicable aux obligations alimentaires ainsi qu’à l’adhésion de l’Albanie à la Convention de La Haye du premier mars 1954 relative à la procédure civile et à la Convention de La Haye du premier février 1971 sur la reconnaissance et l’exécution des jugements étrangers en matière civile et commerciale. Il a également assisté à la mise en ligne de la version allemande du site Internet de la Conférence. Cette deuxième adaptation du site Internet dans une langue non officielle de la Conférence1 a été réalisée grâce au soutien des gouvernements autrichien, allemand et suisse. Le Conseil a pris des décisions relatives aux travaux actuels et futurs de la Conférence et examiné et approuvé le large éventail d’activités menées par le Bureau Permanent pour promouvoir et garantir la mise en œuvre efficace et le bon fonctionnement des Conventions de La Haye. Le Conseil a approuvé les comptes de l’Exercice financier LIV (premier juillet 2008 – 30 juin 2009) présentés par le Secrétaire général de la Conférence et a examiné et approuvé le projet de budget de l’Exercice financier LVI (premier juillet 2010 – 30 juin 2011). Council on General Affairs and Policy The Council on General Affairs and Policy of the Hague Conference met from 7 to 9 April 2010 in the Academy Building on the grounds of the Peace Palace in The Hague under the chairmanship of Mr Antti Leinonen, Expert from Finland. The Council witnessed the signing and ratification (acceptance) by the European Union of the 2007 Protocol on the Law Applicable Law to Maintenance Obligations, and the accession by Albania to the Hague Convention of 1 March 1954 on Civil Procedure and the Hague Convention of 1 February 1971 on the Recognition and Enforcement of Foreign Judgments in Civil and Commercial Matters. During the Council meeting the German version of the website of the Conference was launched. German is the second non-official language of the Conference in which the website of the Conference is available.1 This was made possible with assistance of the Governments of Austria, Germany and Switzerland. The Council took decisions relating to current and future work of the Conference and reviewed with approval the broad range of activities being carried out by the Permanent Bureau to promote and to ensure the effective implementation and operation of the Hague Conventions. The Council commended the development of regional programmes and welcomed the ongoing initiatives to strengthen the regional presence of the Hague Conference in Latin America and in the Asia-Pacific region. It welcomed the achievements of the Permanent Bureau in the areas of education, training and technical assistance in relation to the Hague Conventions. The Council encouraged the further development of the International Centre for Judicial Studies and Technical Assistance and supported efforts to strengthen its resources, capacity and expertise in response to the growing demand for post-Convention services.2 Further to the Council’s invitation, a geographically representative open-ended working group of Members was convened in The Hague on 2 and 3 December 2010 under the chairmanship of Ms Kathryn Sabo, Expert from Canada, to discuss possible improvements in

Council of Diplomatic Representatives The Council of Diplomatic Representatives met on 6 July 2010 and was chaired by Mr Ed Kronenburg, Secretary General, Ministry of Foreign Affairs, on behalf of the Minister of Foreign Affairs of the Netherlands. The Council approved the accounts submitted by the Secretary General of the Hague Conference for Financial Year LIV (1 July 2008 – 30 June 2009) and discussed and approved the draft Budget for Financial Year LVI (1 July 2010 – 9 annual report 2010 | organisationle nouveau système de financement du régime de pension de la Conférence. Struycken a présidé la Dix-huitième session de la Conférence de La Haye (1996), la Commission spéciale à caractère diplomatique (1999), ainsi que les Dix-neuvième (20012002), Vingtième (2005) et Vingt et unième (2007) sessions et a pris part en qualité de délégué et d’expert des Pays-Bas à 74 Sessions diplomatiques et Commissions spéciales.

Il a également participé à l’expansion stratégique de la Conférence, notamment au regard de ses relations avec l’Union européenne. Il a fortement soutenu la Conférence et ses travaux à une époque difficile de l’histoire de l’Organisation. Le Professeur Paul Vlas lui a succédé le premier janvier 2011. Bureau Permanent En février 2010, Mme Céline Chateau, qui était Directrice de l’administration, a quitté le Bureau Permanent. Le Bureau Permanent est très reconnaissant à Mme Chateau pour son investissement personnel et ses multiples contributions aux travaux de la Conférence pendant près de dix ans. Mme Anna Koelewijn, qui est de nationalité américaine, lui a succédé à effet de septembre 2010. En février 2010, Mme Hannah Baker a rejoint le Bureau Permanent en qualité de Collaboratrice juridique. Mme Baker, qui est de nationalité britannique, se consacre principalement aux Conventions relatives aux enfants. Mme Maja Groff, de nationalité américano-canadienne, a également été recrutée en qualité de Collaboratrice juridique ;

Mme Berkhout est de nationalité néerlandosrilankaise. En outre, deux Collaborateurs juridiques ont été recrutés à titre temporaire dans le cadre du Budget supplémentaire : M. Alexander Kunzelmann, qui a effectué un stage au Bureau Permanent au premier semestre 2010 dans le cadre du Programme Peter Nygh, a été recruté en juillet en qualité de Collaborateur juridique. M. Kunzelmann est de nationalité australo-suisse et son travail porte principalement sur l’entraide judiciaire et administrative et le contentieux international. En août 2010, Mme Sandrine Pépit, ressortissante française, a intégré l’équipe chargée de la Convention Adoption internationale de 1993 en qualité de Collaboratrice juridique au terme d’une mission de conseil de six mois. The Council took a number of important decisions concerning the new system of financing the Pension Scheme of the Conference. The Supplementary Budget for Financial Year LVI, which seeks voluntary contributions from Members, was also discussed and States were encouraged by the Chair to continue to generously contribute to this Budget. Standing Government Committee on Private International Law On 31 December 2010 Professor A.V.M. (Teun) Struycken retired as President of the Standing Government Committee on Private International Law. He chaired the Eighteenth Session of the Hague Conference (1996), the Special Commission of a Diplomatic Character (1999), as well as the Nineteenth (2001-2002), Twentieth (2005) and Twenty-First (2007) Sessions. As a delegate and expert of The Netherlands he participated in 74 Diplomatic and Special Commission meetings. He was also involved in the strategic development of the Conference, especially with regard to its relationship with the European Union. He has been enormously supportive to the Conference and its work in a challenging period in the history of the Organisation. He was succeeded on 1 January 2011 by Professor Paul Vlas. Permanent Bureau In February 2010 Ms Céline Chateau left her position as Administrative Director at the Permanent Bureau. The Permanent Bureau is highly appreciative to Ms Chateau for her dedication and many contributions to the work of the Hague Conference for almost ten years. Ms Anna Koelewijn, who is of American nationality, was appointed as Head of Administration per September 2010. In February 2010, Ms Hannah Baker joined the Permanent Bureau as Legal Officer. Ms Baker is of British nationality and her work mainly focuses on the Hague Children’s Conventions. Also Ms Maja Groff, of Canadian-American nationality, was recruited as Legal Officer and her work mainly focuses on the 2007 Child Support Convention and the 2000 Adults Convention. In March 2010, Ms Micah Thorner joined the Permanent Bureau as Legal Officer with a special focus on the activities of the Centre and its financial and organisational aspects, working closely with the Director of the Centre and the Secretary General. Ms Thorner is of American nationality. Also in March, Ms Maryze Berkhout joined the Permanent Bureau as Human Resources Assistant. Ms Berkhout is a dual DutchSri Lankan national. In addition, two Legal Officers were recruited under the Supplementary Budget on a temporary basis: Mr Alexander Kunzelmann, who joined the office as the Peter Nygh Programme intern in the first semester of 2010, has been recruited as of July 2010 as a Legal Officer.
