CIRCULAR NÚMERO 07 DE 2013

REFERENCIA: Por la cual se incorporan unos medicamentos al régimen de control directo con fundamento en la metodología de la Circular 03 de 2013 de la Comisión Nacional de Precios de Medicamentos y Dispositivos Médicos y se les fija su precio máximo de venta • En ejercicio de ·sus facultades legales contenidas en el artículo 245 de la Ley 100 de 1993 y, en desarrollo de la Ley 1438 de 2011 y, CONSIDERANDO: Que el artículo 245 de la Ley 100 de 1993 y el artículo 87 de la Ley 1438 de 2011 confirieron a la Comisión Nacional de Precios de Medicamentos y Dispositivos Médicos

(en adelante la "Comisión") la potestad de regular los precios de los medicamentos. Que la política farmacéutica, expedida mediante el documento CONPES Social 155 del 30 de agosto de • 2013, instruyó a la Comisión desarrollar una política de precios de medicamentos orientada a detectar y resolver las distorsiones del mercado de medicamentos. Que la Comisión expidió la Circular 03 de 2013 mediante la cual estableció la metodología para la aplicación del régimen de control directo de precios en el país. Que en aplicación de esa metodología, la Comisión, a través del Grupo Técnico Asesor, dispuso para consulta pública la información utilizada para obtener los precios máximos de venta de los medicamentos regulados mediante la presente circular, con el fin de que los interesados pudieran hacer los comentarios y las solicitudes que consideraran pertinentes.

Que los soportes técnicos que sirvieron para el cálculo de los precios máximos de venta señalados en el artículo 1 de esta circular se encuentran disponibles en las páginas web de los Ministerios de Salud y Protección Social y Comercio Industria y Turismo. Que la Comisión analizó todos los comentarios y solicitudes recibidos y posteriormente, tomó las decisiones definitivas que se reflejan en la presente circular. Que dadas las políticas de transparencia de la Comisión, tanto los comentarios como las respuestas se encuentran publicados en las páginas web anteriormente mencionadas. Que la Comisión estima pertinente impedir la limitación del efecto de la regulación sobre los ahorros para el sistema de salud a partir de presentaciones no reguladas o nuevas presentaciones de mercados relevantes regulados. Que durante el proceso de consulta de las Circulares 04 y 05 de 2013 y durante el tiempo • que han estado vigentes, la Comisión y el Ministerio de Salud y Protección Social han· recibido comentarios de Instituciones Prestadoras de Salud (IPS) del país que expresan su preocupación por el efecto negativo que tiene la regulación de •p recios en su sostenibilidad financiera, al no reconocer el valor que ellas agregan a la cadena de distribución de los medicamentos. medicamentos de alto costo, un margen representado en un porcentaje del precio, podría no necesariamente representar el costo del valor agregado por parte de las IPS. Que la reducción de las asimetrías de información es un objetivo importante para la Comisión por cuanto contribuye a corregir las distorsiones del mercado y permite mejorar las negociaciones entre los distintos actores de la cadena de distribución de medicamentos. En mérito de lo expuesto y en aplicación de la metodología establecida en la Circular 03 de 2013 la Comisión RESUELVE Artículo 1. Subconjunto de medicamentos de mayor participación. Para los mercados relevantes con más de tres concurrentes e IHHx superior a 2.500 de que trata el artículo ,, 19 numeral b) de la Circular 03 de 2013, se considera que los medicamentos de mayor participación corresponden a todos aquellos medicamentos con participación igual o superior al 10% del mercado relevante. Artículo 2. Incorporación de medicamentos a control directo.
