CONSIDERAR EL PROYECTO DE DECLARACIÓN Y PLAN DE ACCIÓN DE

SAN SALV ADOR SOBRE SEGURIDAD CIUDADANA EN LAS AMÉRICAS

La PRESIDENTA: We are convened principally today, colleagues, to hear a report from the Chair of the Working Group to Consider the Draft Declaration and Plan of Action of San Salvador on Citizen Security in the Americas. That document is AG/CP/GTDSS-6/11 rev. 7 corr. 1.

Señora Presidenta y señores Representantes, en mi condición de Presidente del Grupo de Trabajo Encargado de Considerar el Proyecto de Declaración y Plan de Acción de San Salvador sobre Seguridad Ciudadana en las Améric as, tengo hoy el honor de presentar a la Comisión Preparatoria de la Asamblea General el resultado de los trabajos que fueron encomendados al Grupo, en preparación del cuadragésimo primer período ordinario de sesion es de la Asamblea General, que se celebrará en San Salvador.

El 23 de marzo del presente año, esta Comisión Preparatoria instaló el Grupo de Trabajo para

El 23 de marzo del presente año, esta Comisión Preparatoria instaló el Grupo de Trabajo para considerar la propuesta presentada por el Gobierno de El Salvador como Proyecto de Declaración y Plan de Acción de San Salvador sobre Seguridad Ci udadana en las Américas. Para llevar adelante3dichos trabajos, el Grupo en mención, cuyas sesi ones fueron presididas en mi representación por el Ministro Consejero Agustín Vásquez, Representante Alterno de El Salvador, celebró sesiones formales los días 5, 19 y 27 de abril y 2, 4, 9, 13 y 16 de mayo. Dicho Grupo de Trabajo realizó, además, varias reuniones de carácter informal para acercar posiciones y para la redacción de las propuestas.

Las labores con relación a la propuesta presenta da por el Gobierno de El Salvador se iniciaron con consultas informales de mi Delegaci ón con las demás delegaciones, individualmente y por subgrupos regionales, para conocer las difere ntes reacciones iniciales. Asimismo, durante la primera reunión formal del Grupo de Trabajo se reci bieron comentarios y observaciones de carácter general a la propuesta original. Con base a las propuestas recibidas y con el voto de confianza otorgado por los miembros del Grupo de Trabajo, la Presidencia del Grupo elaboró el documento de trabajo que sirvió de base para las negociaciones.

En el transcurso de las deliberaciones quedaron establecidas la necesidad y la importancia de reconsiderar y reformular, en cuanto al aspecto de forma, la propuesta original del Gobierno de El Salvador con relación a la propuesta a la Asamblea General, en su cuadragésimo primer período

SEGURIDAD CIUDADANA EN LAS AMÉRICAS: Muchas gracias.

Continúo. En una demostración de amplio multilateralismo y apertura a las posiciones expresadas, la Delegación de El Salvador apoyó una reformulación en dicho sentido y acompañó el consenso para que el Plan de Acción resultante fuese elaborado en seguimiento a la Declaración de San Salvador como una encomienda específica de la Asamblea General al Consejo Permanente, la cual quedó establecida en el texto de la Declaración.

Acordado lo anterior, el título de la propuest a original del Gobierno de El Salvador fue modificado para eliminar la referencia al Plan de Acción. Una enmienda en el calendario de la Asamblea General debería realizarse en ese sentido.

Se ha organizado el proyecto de la Declaraci ón de San Salvador sobr e Seguridad Ciudadana, que hoy presenta la Presidencia del Grupo de Trabajo a esta Comisión Preparatoria, tomando en

En tal sen tido, los antecedentes conceptuales dan validez y justificación al título de la Declaración.

Seguidamente se han identificado los principios generales que, en un marco democrático, deben incluir cualquier política o estrategia nacional en la materia, habiéndose abordado los factores de riesgo y cómo estos afectan a las poblaciones, en pa rticular a las que se encuentran en situación de4vulnerabilidad frente a cierto tipo de delitos, incluyendo aquellos delitos que son de gran preocupación para los Estados Miembros y que pueden aumentar la inseguridad en nuestra región.

Finalmente, se han abordado lo s mecanismos y las medidas de respuesta que deben ser impulsadas tanto para mejorar las condiciones de seguridad de las poblaciones como para promover el desarrollo integral y las acciones en materia de cooperación.

Señora Presidenta y distinguidos Representantes, las negociaciones que permitieron lograr un acuerdo de consenso con relación al proyecto de D eclaración que tengo el honor de presentar, fueron largas y en algunas ocasiones difíciles. El tema Seguridad Ciudadana aborda aspectos muy diversos, con diferentes perspectivas y, en consecuencia, en algunos aspectos plantea una problemática sobre su abordaje para algunos de los Estados Miembros. Sin embargo, el haber logrado un acuerdo sobre este documento es el testimonio de la apertura, flexib ilidad y concesión demostradas por todas y cada una

Por ello El Salvador demuestra y afirma ese agradecimiento.

Debo indicar, sin embargo, que el documento que hoy presento tiene dos puntos aún sujetos al acuerdo de dos distinguidas delegaciones, cuyo apoyo y colaboración, debo reconocer aquí, han estado latentes en todo momento.

Sobre el particular, la Presidencia del Grupo de Trabajo, anfitrión de la Asamblea General, esperaría que se pudiera alcanzar una decisión final y de consenso en este momento, lo cual asegurará desde ya un diálogo sustantivo de nuestros Cancilleres sobre la materia.

Señora Presidenta, con estos comentarios la Misión Permanente de El Salvador se siente satisfecha de la labor real izada y se honra en presentar de manera formal a la Comisión Preparatoria el Proyecto de Declaración de San Salvador sobre Seguridad Ciudadana en las Américas, a efecto de que en la forma consensuada en que se está presentando y de conformidad c on los procedimientos y normas establecidos, sea elevado al conocimiento y consideración de los señores Cancilleres de las Américas, a reunirse en la ciudad de San Salvador en el marco del cuadragésimo primer período ordinario de sesiones de la Asamblea General.

Al concluir las labores del Grupo de Tr abajo, deseo expresar mi reconocimiento y agradecimiento por el apoyo y la colaboración recibidos de todas las delegaciones, lo que hizo posible la conclusión oportuna de las tareas que nos fueron encomendadas.

We look forward to receiving the ha rd copy or the e-copy so that we can all duly forward it to our capitals. I take the opportunity to commend you, in your capacity as Chair of the Working Group to Consider the Draft Declaration and Plan of Action of San Salvador on Citizen Security in the Americas, as well as the members of the Working Group, on the excellent work done and the tremendous effort put in by all the members to successfully negotiate a consensus document.

I do note that there are two ad referendum issues in the document with regard to the title and declaratory paragraph 16. I now offer the floor to the delegations of Mexico and Canada on those two items so that we can hear from them whether we can send a consensus document to the General5Assembly, or whether this Preparatory Committee of the General Assembly can so report to the Plenary.

Desafortunadamente, señora Presidenta, el título sigue siendo objeto de consulta, atención y consideración por parte de mis autoridades en la ciudad de México, por lo que en este momento no estaría yo en condiciones de retirar el ad referéndum al título.

La PRESIDENTA: Thank you, Ambassador. The Chair would only encourage that we receive a response or that the consultations be co ncluded prior to the General Assembly session. If that is possible, then the Secretariat will make th e adjustment to the title of the text, if there is no amendment by the Delegation of Mexico, and then circulate a new version prior to the General Assembly session. However, if the Delegation of Mexico has an amendment, it would have to be considered at a subsequent meeting of the Preparatory Committee, so we look forward to hearing further from your delegation, Ambassador.

La REPRESENTANTE ALTERNA DEL CANADÁ: Thank you, Madam Chair, and Canada would begin by expressing gratitude to Ambassa dor Maza and his delegation for stewarding the process of this declaration.

Madam Chair, to go back to a comment that you made on the process, it is our understanding that this declaration will be conveyed from the Pr eparatory Committee to the Permanent Council. It is with some surprise that we note that it is not on today’s order of business of the Permanent Council. Perhaps you could illuminate us as to its status, but it is our understanding that this document would indeed be considered by the Permanent Council be fore being conveyed to the General Assembly, in keeping with OAS practice.

Canada is continuing to consult on operative paragraph 16, and we will be maintaining our ad referendum status. Thank you.

There may be some room for that if the Chair of the Working Group so requests during that meeting, but it is not the normal procedure at all because it is not in the Rules of Procedure of the General Assembly or of the Permanent Council. I just wanted to correct that interpretation. Thank you very much.

Likewise, as I indicated to the Delegation of Mexi co, if the Delegation of Canada could inform the Secretariat of the conclusion of its consultations , and if there is no amendment proposed by the Delegation of Canada to paragr aph 16, the Secretariat will so indicate by removing the ad referendum. Mi Delegación entiende que esta es la última reunión de la Comisión Preparatoria y que ta mbién en ella estamos ya aprobando el proyecto de Declaración, ad referéndum de dos delegaciones por cuestiones diferentes. En consecuencia, entendemos que la próxima ocasión en que se va a tratar el tema del proyecto de Declaración será ya en El Salvador.

Quisiera que, por favor, eso que dara claro, Presidenta. Lo digo simplemente porque todos estamos sobrecargados de trabajo. En este momento hay muchas negociaciones en curso y la verdad es que por lo menos este capitulo quisiéramos cerrarlo de una vez, si fuera posible.

La PRESIDENTA: Thank you very much, Ambassador. You’ve echoed the sentiments expressed by the Chair to have a closed document, but one that is closed with full consensus. I’ve urged the two delegations that are so far not joinin g the consensus to try to close those consultations with their capitals and submit a response to the Secretariat prior to the General Assembly session. Again, we commend you and all the delegations for your excellent efforts and for your success in bringing to us today a draft declaration that enjoys the consensus of the majority of the states. We note that the two delegations don’t oppose anything but have raised points regardi ng single items in the text. We also agree that this Preparatory Committee will forward the text to the General Assembly as is if no other delegations proposed changes. There being no other requests for the floor on this matter, it is so agreed.
