La Delegación de Nicaragua quiere expresar su objeción a la aprobación del numeral romano III.28 que aparece en el proyecto de temario que se menciona en el orden del día de esta sesión, y quiere expresar lo siguiente:

“El Gobierno de la República de Nicaragua reafirma su rechazo a la inclusión del tema “La Situación en Nicaragua”, en el proyecto preliminar de temario del cuadragésimo noveno período ordinario de sesiones de la Asamblea General de la Organización de los Estados Americanos, a realizarse en la ciudad de Medellín, Colombia, del 26 al 28 de junio de 2019, por considerar que es un acto injerencista en los asuntos internos de Nicaragua, desconociendo los avances del Gobierno de Reconciliación y Unidad Nacional (GRUN) y del fortalecimiento de l a paz y la armonía entre los nicaragüenses. Expresamos nuestro desacuerdo con la inclusión de este tema y solicitamos el retiro del mismo del proyecto de temario del cuadragésimo noveno período ordinario de sesiones de la Asamblea

En el documento relativo al temario que termina con número revisión 4 –existe en la sección numeral III– hay diferentes temas que van del 25 al 31, que han sido propuestos por diferentes delegaciones y que no se han incorporado al temario, entonces quisiera saber, nada más ¿Cuál es el orden de las decisiones que vamos a tomar respecto a estos temas? Porque si va a ser orden consecutivo o a petición de cada delegación ¿vamos a ir votando tema por tema? para tener claridad en el entendido de que estos últimos temas son sobre los que tenemos que decidir para su inclusión, o no, en el temario.

So, since it has been a vote requested, Nicaragua has voted to not accept the agenda as proposed. Just to clarify. I think we had confirmed last week that, in proceeding , today items that were existing on the agenda would require eighteen votes, if we were to vote on them subsequently. My concern is if we vote on the agenda as is, there are a number of ambiguities. If we are proceeding to an item-by-item vote on items that are raised, that are contentious, are we done talking about an 18 -vote threshold?

And then, secondly, I simply wanted to support what was just put on the table by the Delegation of Costa Rica. The presence of the item on Nicaragua on the agenda is consistent with the Permanent Council resolution, and I want it to make sure that was very clear. This is an item for discussion that it is part of the resolution that we agreed, I guess almost two weeks ago now. So if you could clarify that threshold that will be great. Thank you.

So I just wanted to point that out and if we can get some clarification, what you have already approved the agenda for this morning’s meeting.

And I therefore wish now to request the withdrawal of the proposed topic from the preliminary draft agenda that is the topic at item 31.9

En primer lugar, permítame extender nuestro agradecimiento a las Delegaciones de Colombia y Trinidad y Tobago por su flexibilidad en retirar los mencionados temas de la propuesta de temario, con lo cual creo que podremos avanzar en el camino hacia nuestros preparativos. En segundo lugar, queremos también agradecer el documento que fue circulado por la Delegación de los Estados Unidos con relación al tema número 27, hacia la Reforma de la Organización de los Estados Americanos.

Señor Presidente, mi Delegación considera que, habiendo revisado esa not a, observamos que la mayoría de los temas que se buscan incluir en esta discusión son temas que realmente ya se están discutiendo en el marco de la Comisión de Asuntos Administrativos y Presupuestarios (CAAP); lo que tiene que ver con recursos humanos; presupuestación eficiente; funciones de auditoria, todos temas que mi Delegación apoya, pero que ya están siendo discutidos en la CAAP y se elevarán por esa vía a la Asamblea General.

Ahora bien, con referencia a la reforma al sistema de votación que se menc iona en ese documento, este tema nos preocupa porque para reformar el sistema de votación de la Organización de los Estados Americanos necesitaríamos, de hecho, reformar la Carta de la OEA. No se trata nada más10

de revisar reglamentos o procedimientos sino que se requeriría una reforma a la Carta. Mi Delegación considera que no estamos en una posición para iniciar un proceso de esa naturaleza; de abrir nuestro

Pensamos también que varios de estos temas tuvieron amplia oportunidad de discutirse en el marco del Grupo de Trabajo sobre Fortalecimiento Institucional de la OEA que, muy hábilmente, presidió el Embajador de Guyana, Riyad Insanally, y que justamente acaba de concluir sus trabajos y nos entregó ya sus resultados. De manera que no nos parece que este nuevo tema tenga lugar en este momento y en el marco de este período de sesiones de la Asamblea General. Más particularmente, nos preocupa la reforma que se propone al sistema de votación que tiene implicaciones de largo alcance, que mi Delegación no está preparada para comenzar a discutir en este momento.

Mi Delegación coincide con lo planteado por la distinguida Delegada de México, en el sentido de que muchos de los temas planteados en esta propuesta hacia una reforma a la Organización de los Estados Americanos, ya vien en siendo analizados en la Comisión de Asuntos Administrativos y Presupuestarios; iniciaría ahí todo un proceso y hay un procedimiento de análisis correspondiente de todos y cada uno de ellos. Tampoco consideramos que hay condiciones como tampoco es de interés de los cancilleres entrar en un proceso de reforma de la Carta de la Organización de los Estados Americanos, que implicaría reformas al sistema de votación, sobre todo encontrándonos a casi un mes

El REPRESENTANTE PERMANENTE DE LOS ESTADOS UNIDOS: I think we are going to withdraw. I can easily do a brief explanation because I realize that there have been questions about this initiative and we were planning an informal briefing for delegations next w eek, but we think it is an excellent opportunity to build on a lot of the progress of reform that has been made in previous years. We realize, some of these initiatives may duplicate the initiatives of other missions including the cooling off period that w e originally tabled that Costa Rica had already introduced, but we are really trying to do is build on the progress made in other areas.

We realize that some of these issues come up in the Committee on Administrative and Budgetary Affairs (CAAP), but not all of them do. So, we will welcome the opportunity for more dialog in the context of the regular session of the General Assembly on these important issues, because for the United States as the single largest donor in the OAS on the eve of the implementation of other reforms. We want to make sure that the positive momentum we have for reform continues strong, because it is very important for us to be able to show that the institution is effective and efficient and represents all member states’ interests well, in order to assure continued political support within our system.11

So, I realize that one of the issues is voting and we would love the opportunity to discuss this because at this point the OAS voting procedures do not align with other international institutions,

When it comes, for example , to abstentions, abstentions count as essentially, practically as negative votes and we think that abstentions should actually not count. Since it is an act of not voting, it should not count as a vote, either affirmative or positive, and at the very very least, we would welcome the opportunity to discuss this and other issues in greater depth.

And as far as transparency, which is a high priority for the OAS mission, transparency in the way this Organization is run, not only from a budgetary point of view , but more broadly from an administrative and management point of view. One of our ideas was to strengthen existing internal audit systems with external audit systems that, for example, the United Nations and other international organizations use, including one that is known by the acronym MOPAN, the Multilateral Organization Performance Assessment Network, which is sometimes brought in to do an external assessment of the administrative and budgetary functions of International Organizations (IOs) in order to either confirm that it is being well run or to identify problems that can be address and headed off.

So we urgently plea that the other delegations support our ability to at least discuss these issues in the context of the General Assembly, rather than cut off such discussion.
