REPORT BY THE CHAIR OF THE WORKING GROUP

TO THE COMMITTEE ON ADMINISTRATIVE AND BUDGETARY AFFAIRS PRIORITY REFORMS TO THE STATUTE OF THE ADMINISTRATIVE TRIBUNAL The Chair of the Working Group is pleased to submit the following report to the Committee on Administrative and Budgetary Affairs (CAAP) regarding the Working Group’s consideration of the priority reform items to the Statute of the Administrative Tribunal of the Organization of American States. The Administrative Tribunal initially submitted for the consideration of the CAAP a draft reform of the Statute of the Tribunal, which was circulated as document CP/CAAP-3960/24. Although the proposal was transmitted in 2024, the Committee was not in a position to undertake its analysis during the previous year due to competing priorities. Subsequently, following further exchanges with the Administrative Tribunal, the Tribunal submitted an additional communication identifying three priority issues for the consideration of the CAAP. That communication was circulated as document CP/CAAP 4167/25. At the last meeting of the CAAP held in 2025, on December 9, 2025, the Committee received a presentation from the then President of the Administrative Tribunal, Judge Pablo Sandonato de León, regarding the proposed reforms and the rationale for prioritizing specific amendments to the Statute. Following that presentation, and taking into account that the matter required closer and more detailed analysis, the CAAP entrusted the Working Group with the deliberations on the priority items identified by the Administrative Tribunal.

In preparation for the Working Group’s consideration of this matter, the Delegation of Mexico submitted in writing a series of comments and questions, to which the Administrative Tribunal responded in document CAAP/GT/RVPP582/26. The Working Group considered this matter at its recent meeting held on March 24, 2026, during which it welcomed the participation of the current President of the Administrative Tribunal, Judge Janet Nosworthy, as well as Judge Pablo Sandonato de León. Both judges provided introductory and clarifying remarks regarding the proposed reforms and responded to observations and questions from delegations.- 2In the course of the deliberations, the Chair took note of the reservations expressed by two delegations, with respect to one element of the proposed language in Article 3 concerning gender balance. In light of the discussion, the Working Group agreed that progress could be made on the three priority articles, with the exception of the outstanding language in Article 3 concerning gender balance, which would remain under consideration for future discussion. At the close of the meeting held on March 24, 2026, President Nosworthy expressed appreciation for the progress achieved by the Working Group and underscored the importance of the reform process in strengthening both access to justice and broader considerations of representation within the Tribunal. At its meeting held on April 15, 2026, the Working Group considered and agreed upon the draft resolution “Reforms of the Statute of the Administrative Tribunal” and decided that it be submitted to the CAAP for transmission to the Permanent Council with a view to its consideration and approval by the General Assembly. The Chair wishes to express appreciation to the members of the Administrative Tribunal, the delegations, and the General Secretariat for their constructive engagement and valuable contributions to the consideration of this matter.
