FOLLOW-UP ON THE SITUATION IN NICARAGUA

(Adopted by the Permanent Council at its regular meeting, held on February 4, 2026) THE PERMANENT COUNCIL OF THE ORGANIZATION OF AMERICAN STATES, CONSIDERING the provisions of the Charter of the Organization of American States; the American Declaration of the Rights and Duties of Man; the American Convention on Human Rights; the Inter-American Democratic Charter; the resolutions of the General Assembly and the Permanent Council on the matter; and other relevant inter-American instruments on human rights; TAKING INTO ACCOUNT that the American Convention on Human Rights remains fully in force with respect to Nicaragua and, therefore, the general obligation to respect the rights recognized therein and ensure the free and full exercise of those human rights, without discrimination, constitutes a legal and ethical imperative in its actions; EXPRESSING CONCERN over Nicaragua’s actions and its lack of participation in regional and international mechanisms of human rights which reduces the channels available to address the pressing human rights, humanitarian, labor, and development challenges affecting its people; CONCERNED about the persistence of the grave human rights situation and impunity, as well as the deterioration of democratic institutions in Nicaragua, described by the September 23, 2025 1 / report of the Group of Human Rights Experts on Nicaragua (GHREN) of the UN Human Rights Council, the Office of the United Nations High Commissioner for Human Rights, the Inter-American Commission of Human Rights (IACHR) and the Inter-American Court of Human Rights (IACtHR), as well as in the resolution adopted by the OAS General Assembly on June 27, 20242 / ; ALARMED by the latest report of the GHREN, which documents acts of harassment,

persecution, and attempts against life that extend beyond Nicaragua’s land borders; including through the instrumentalization of international cooperation mechanisms, such as the misuse of INTERPOL Red Notices, the circulation of false alerts regarding travel documents, and the manipulation of financial compliance regulations;

DEEPLY CONCERNED about the adoption of new measures and decisions by the State of Nicaragua that have deepen the undermining of freedom of expression, the elimination of provisions prohibiting torture, and the removal of references to respect for human dignity as a national principle, which are contrary to the obligations of the American Convention of Human Rights; NOTING that, more than a year after ceasing to be a member of the Organization of American States, and despite the clear willingness of regional States to establish a constructive dialogue, as expressed in resolutions AG/RES. 3022 (LIV-O/24) and CP/RES. 1252 (2492/24), the State of Nicaragua has not shown willingness to cooperate, both bilaterally and multilaterally, to address the grave institutional and human rights situation; REITERATING the willingness of the Permanent Council of the Organization of American States and its Member States to engage constructively with the State of Nicaragua in pursuit of the objectives of this resolution; ACKNOWLEDGING the information reporting the release to house arrest of political opponents and dissidents, journalists, Catholic church lay workers, and other persons unjustly deprived of their liberty; and RECALLING that the OAS General Assembly instructed the Permanent Council, in its

resolution AG/RES. 3022 (LIV-O/24) of June 27, 2024, to “maintain its attention, within the framework of inter-American instruments, on the situation in Nicaragua, facilitating and articulating initiatives for dialogue, negotiation, and visibility”,

RESOLVES:

1. To condemn the grave violations and abuses committed by the Nicaraguan authorities against individuals’ rights, both within the country and abroad, in particular those acts involving: forced exile, expatriation, torture or cruel treatment, enforced disappearance 3 / , arbitrary detention, unjust seizure and confiscation of assets, including properties and pension contributions, deletion of official identity records, prevention of family reunification, prohibition of entry into one’s own country, denial of issuance or renewal of passports and destruction of official documents, surveillance, threats, harassment, and attacks against the life and integrity of hundreds of Nicaraguans; many of these which, according to the latest GHREN4 / report, would constitute crimes against humanity.

2. To urge the State of Nicaragua to end human rights violations, including through the unconditional release of all unjustly detained individuals and those unjustly confined to house arrest, particularly those whose whereabouts are unknown or who are beneficiaries of precautionary or provisional measures from the IACHR or the IACtHR, respectively.

3. To urge the State of Nicaragua to take prompt measures in order to comply with its international human rights obligations, to restore checks, balances, and independence of powers inherent to a rule of law and democracy.

4. To urge the State of Nicaragua to restore civic space, end reprisals, and ensure full respect for the freedoms and rights established in the American Convention on Human Rights and other international human rights law instruments applicable to Nicaragua.

5. To urge the State of Nicaragua, according to relevant international standards and its obligations to adopt effective actions to guarantee truth, justice, and reparations for victims, and end impunity for grave violations of human rights committed in the country.

6. To call on the State of Nicaragua for the prompt full release for persons unjustly deprived of liberty or under house arrest for political reasons, and to ensure that their conditions of detention comply with applicable human rights international obligations.

7. To take note of the resolutions adopted by the IACtHR granting or extending provisional measures to protect persons at risk, including Nicaraguans who may be outside Nicaragua.

To urge Member States, consistent with their obligations within their territory and jurisdiction, to take these decisions into account when assessing requests for asylum, protection, or when considering transfer, as part of their commitment to the protection of human rights within the framework of the Inter-American System.

8. To request the IACHR, within the scope of its competency, to continue its close monitoring of the human rights situation in Nicaragua, as well as those violations allegedly arising from Nicaragua’s actions outside its territory, through its Special Monitoring Mechanism for Nicaragua

(MESENI), and report regularly to this Permanent Council.

9. To recommend that the IACHR, within the framework of its mandate, available resources and in accordance with inter-American procedures, analyze the effects and consequences of Nicaragua's alleged misuse of international legal cooperation mechanisms, among others, taking into account, the information provided by GRHEN5 / , among other available sources, in order to be presented to the Permanent Council for its consideration.

10. To reiterate the call to the State of Nicaragua to engage in constructive dialogue with

the international community, both bilaterally and multilaterally, aimed at ending human rights violations and impunity, and advancing the restoration of democratic institutions. Likewise, reaffirm the full willingness of the Organization of American States and its Member States to participate in and support such dialogue efforts.

11. To call upon the State of Nicaragua to return to the Organization of American States, reiterating the willingness of Member States to facilitate this process, in accordance with the provisions of the OAS Charter and aligned with the principles the Inter-American Democratic Charter.
