CELEBRADA EL 10 DE ABRIL DE 2024

En la ciudad de Washington, D. C., a las diez y cuatro de la mañana del miércoles 10 de abril de 2024, celebró sesión extraordinaria el Consejo Permanente de la Organización de los Estados Americanos con el propósito de tratar el tema de “ La violación de la Convención de Viena sobre Relaciones Diplomáticas y su relación con la figura del asilo, así como las lesiones sufridas por el personal diplomático mexicano en Ecuador ”. Presidió la sesión el Embajador Chet Donovan Neymour, Representante Permanente del Commonwealth de Las Bahamas y Presidente del Consejo Permanente. I have the honor to declare open this session of the special meeting of the Permanent Council pursuant to Article 14 of the Statutes of the Permanent Council, and Article 37 of its Rules of Procedure.

The meeting this morning is convened at the request of the Permanent Missions of Bolivia and Colombia to address, and I quote: “The violation of the Vienna Convention on Diplomatic Relations,

El PRESIDENTE: Colleagues, I will move on to item 2 which is the consideration of the draft resolution, entitled, and I quote: “The intrusion of the Ecuadorian police into the Embassy of Mexico in violation of the Vienna Convention on Diplomatic Relations, and the Institution of Diplomatic Asylum,” as outlined in document CP/doc. 5984/24 rev. 1, and presented by the Permanent Mission of

Colombia.

Before opening the floor for discussions, I would like to extend my gratitude to all of the distinguished delegations for their constructive and conciliatory participation in the informal consultations which were convened by the Chair of the Permanent Council yesterday morning.

These consultations were open to all delegations and , I am advised , provided invaluable insights and feedback on the draft resolution that is presented for your consideration this morning. The outcomes of yesterday's meeting have greatly contributed to the consultations conducted by the proposing delegation, thereby enabl ing Colombia to present to us this morning a draft resolution that reflects the broadest possible consensus amongst member states.

Just to be clear, yesterday when Canada participated in good faith in the discussions of this draft text, we made it clear that we had not gotten instruction from Ottawa as to our final position. And we said we would come back with any suggested amendments this morning, which we did. We submitted them to the Secretariat. If the Secretariat was unable to integrate, or circulate them, then that is regrettable.- 7But just to be clear that we had made that transparent effort through the normal processes. And I know there are colleagues around this table who are very keen on transparency and inclusiveness, and so, we did our best efforts to meet those requirements.

Es por esta razón que tomamos la decisión de presentar a este Consejo [Permanente] el [proyecto de] resolución que hoy hemos aprobado y cuyo respaldo agradecemos. Fue objeto de una negociación durante muchas horas el día de ayer, con la participación muy activa de los Estados Miembros, y por su puesto del Ecuador, quien fue que el que más participó para que quedara el texto como fue aprobado el día de hoy. Sobra decir que hay algunos aspectos que no estaban considerados en el mismo, pero de eso se trataba, justamente de dialogar en torno a esto, de discutir y de finalmente llegar con el texto que fue aprobado.

Las consideraciones que planteó el Ecuador el día de ayer, con nuestro saludo especial al señor Viceministro, como justificaciones para irrumpir sin el consentimiento de México en su sede diplomática en Quito, de retirar por la fuerza de sus instalaciones a una persona solicitante de asilo y de ejercer actos contrarios a la Convención de Viena, no pueden ser ace ptadas como tales. Si lo hiciéramos, se considerarían excepciones para su aplicación y ello pone en riesgo el funcionamiento del principio, del desarrollo del principio que a su vez entraña las mínimas garantías de convivencia amistosa y pacífica entre los Estados. Y al respecto me permito solo recordar un pronunciamiento de la Corte Internacional de Justicia, en el caso relativo al personal diplomático consular de Estados Unidos, en Teherán en 1979.

Señor Presidente, en este asunto la Corte sostuvo en 1980 lo siguiente: “No hay un prerrequisito más fundamental en la conducta de las relaciones entre los Estados, que la inviolabilidad de las sedes diplomáticas y embajadas”. Y tiene que ser así, porque es el único camin o para entendernos entre Estados, respetando las normas internacionales que hemos acogido y las cuales han permitido que convivamos pacíficamente.

La irrupción violenta de la Policía del Ecuador en la sede de la Embajada de México y la agresión a su personal, bajo expresa orden del Gobierno del Ecuador, constituye una violación de las normas del derecho internacional que exigen a los Estados solucionar sus divergencias apelando a los medios de solución pacífica previstos en el derecho internacional, que se recogen en la Carta de [la Organización de] las Naciones Unidas (ONU), como bien nos recordaba la propia República de l Ecuador, en este mismo recinto en el año 2012: “Las Convenciones de Viena sobre Relaciones Diplomáticas y Consulares no dejan ninguna duda respecto de la obligación que tienen todos los11Estados de respetar las sedes diplomáticas y consulares. Y, asimismo, en ese momento reconoció Ecuador que “el derec
