El REPRESENTANTE PERMANENTE DE ANTIGUA Y BARBUDA: Thank you very much, Mr. Chair, and good morning to all colleagues.

Mr. Chair, I thank you for the invitation to present to the distinguished members of this Permanent Council, the draft resolution entitled: “Receiving the report of an investigation into allegations concerning the Secretary General and actions thereon.”

much, Mr. Chair, and good morning to all colleagues.

Mr. Chair, I thank you for the invitation to present to the distinguished members of this Permanent Council, the draft resolution entitled: “Receiving the report of an investigation into allegations concerning the Secretary General and actions thereon.”

Representatives here will recall that this [draft] resolution had its genesis in another resolution of this Permanent Council, that was CP/RES. 1210 (2402/22), which we adopted unanimously on November 11, 2022, at a time when faceless persons, describing themselves as “whistleblowers,” made anonymous allegations concerning the Secretary General.

As happens with these matters, when any public official is involved, members of the media took an interest in this matter in the exercise of their right to report and examine issues that they consider are of public interest. The Secretary General was the f irst person to act, both on the anonymous allegations and on the reports of the media, by requesting that the Inspector General of the Organization of American States (OAS) conduct an inquiry.

But this Permanent Council too was concerned about the allegations, which threatened the reputation, the authority, and the confidence in this institution, whose work in upholding democracy, human rights, development, and security is vital to the interests of all our countries of the Americas. Consequently, Mr. Chair, this Permanent Council decided to establish an independent inquiry into the allegations by an experienced and authoritative external company. We were interested in a thorough examination of the allegations, to produce the facts of the matter, and to end all speculation.

We gave the external investigating company three months, until March 31, 2023, to conduct and complete the investigation, and we authorized full and unrestricted access to the necessary documents of the Organization, and to any person the investigators wis hed to interview. When the investigative company asked for more time so as to take testimony from more witnesses, this Permanent Council agreed to extend the time of the inquiry. That is the measure of meticulous diligence that we accorded to the investigators.

documents of the Organization, and to any person the investigators wis hed to interview. When the investigative company asked for more time so as to take testimony from more witnesses, this Permanent Council agreed to extend the time of the inquiry. That is the measure of meticulous diligence that we accorded to the investigators.

Having received the report of the investigators on April 17, 2023, we acted in full accordance with the mandate which we gave ourselves on November 11, 2022.

You, Mr. Chair, immediately made the report available to all member states —as your office was mandated to do —and we, the members of the Permanent Council, immediately began consideration of the report to take appropriate action. We have acted with dispatch and immediacy, as was contained in the mandate in our unanimous resolution of November 11, 2022.- 5Mr. Chair, on behalf of the cosponsors of this [draft] resolution before us, I wish to thank all the delegations of this Organization, which to one extent or another, have worked diligently, carefully, and cooperatively to agree the text of the draft resolution that is now before us.

We have had an open -ended meeting of regional coordinators, which all member states attended, and many gave the cosponsors the benefit of their wisdom in formulating this draft resolution which is the subject of this special meeting.

Additionally, separate meetings were held with many delegations —as late as 10:00 p. m. last night—some collectively, others individually, but always with the single purpose of achieving a [draft] resolution which commanded the broadest consensus amongst all our member states. We approached this work with such meticulousness, Mr. Chair, because we wanted it to be clear to all, that the investigation into the allegations made about the Secretary Gene ral were fully and completely investigated by the independent external company.

In setting out this draft resolution, we were careful to reflect only the findings and recommendations of the investigative report as we received them. Not a single word was changed.

investigation into the allegations made about the Secretary Gene ral were fully and completely investigated by the independent external company.

In setting out this draft resolution, we were careful to reflect only the findings and recommendations of the investigative report as we received them. Not a single word was changed.

“The External Investigation concluded that the Secretary General did not violate OAS Rules and Regulations regarding the obligations of (i) supervision; (ii) salary increases; (iii) intimidation; (iv) travel; or conflicts of interest.”

It also concluded that “the Secretary General violated OAS Rules and Regulations with regard to the provisions on (i) common sense and good judgment; and (ii) additional ethical obligations for the Secretary General;” but it went on to further conclude tha t: “the conduct of the Secretary General does not reflect the level of intentionality necessary to sustain the occurrence of an intentional violation of the Organization of American States (OAS) Rules and Regulations.”

It further concluded that “the allegations in the June 2022 Complaint related to the General Services Employee, lack factual and probative support, determining , therefore, that the Secretary General did not violate the OAS Rules and Regulations in this regard.”

And finally, the report recommended that the Code of Ethics and the Staff Rules and Regulations of the Organization be reviewed and revised to further incorporate best practices in the governing structure.

This draft resolution takes note of all the findings of the report in which the external investigations have fulfilled the task that we asked them to undertake, and it authorizes actions on the recommendation to review and revise the Code of Ethics and the Staff Rule s and Regulations, which must be binding on all without exception.

In dealing with this matter, which is of importance to continued respect for this Organization and its role, on behalf of our member states and our peoples, we have done so with transparency, sincerity, and clarity.

And, Mr. Chair, through this draft resolution, this Permanent Council will conclude the

In dealing with this matter, which is of importance to continued respect for this Organization and its role, on behalf of our member states and our peoples, we have done so with transparency, sincerity, and clarity.

And, Mr. Chair, through this draft resolution, this Permanent Council will conclude the mandate of resolution CP/RES. 1210 (2402/22), of November 11, 2022.- 6Mr. Chair, all have contributed to this draft resolution, which allows us to proceed with the valuable and indispensable work of this Organization, which must at all times be our preeminent objective.

Mr. Chair, against all that I have related, including the deep collaboration of all delegations, my delegation would have moved now to have this draft resolution adopted by acclamation, but given the comment you made at the opening of this meeting that the delegation of El Salvador has a reservation, I will not move that we should adopt this [draft] resolution by acclamation. Though, I must emphasize that given the full extent of all the consultations and negotiations that have preceded this moment, I would have thought that delegations—all of them—would have been ready to move forward in harmony.

But given the fact that our colleague from El Salvador has a procedural difficulty, I will ask Mr. Chair, that we proceed to adopt this [draft] resolution by a vote. And I would ask you to please invite my colleague, the distinguished Ambassador from Guatemala, who is a co-sponsor of this [draft] resolution, to add her voice to this motion.

Thank you.

El REPRESENTANTE PERMANENTE DE ANTIGUA Y BARBUDA: Thank you, Mr.

Chair.

Mr. Chair, as much as you know I dislike having to ask for legal guidance on political matters, I am going to ask for legal guidance in this particular case, because the distinguished delegate from Paraguay raises an important question.

I am going to ask for legal guidance in this particular case, because the distinguished delegate from Paraguay raises an important question.

If we did indeed have consensus —which last night I was led to believe we did —and the only objector that we have had this morning is the distinguished representative of El Salvador, I am sure for very good reason on his part, I would like to be guided by th e legal counsel, as to whether we could proceed with a motion to have this accepted by acclamation, and to see if the body of this Permanent Council agrees with that before we move on any further.

Because, of course, it is always open to the distinguished Ambassador from El Salvador to footnote this [draft] resolution if he so wishes. But I would like to have some clear guidance on that before we go forward.

Gracias, señor Presidente.- 8El PRESIDENTE: Mi estimado doctor Arrighi, muchas gracias.

El REPRESENTANTE PERMANENTE DE ANTIGUA Y BARBUDA: I am indebted to my good friend from El Salvador for his remarks.

I will make two points in relation to what he said.

The fact that we had so many revisions of this [draft] resolution right up until last night is a very solid indication of the seriousness with which the cosponsors took the views of other delegations into consideration in coming up with a final text. There is nothing wrong with that, Mr. Chair, in fact,

The fact that we had so many revisions of this [draft] resolution right up until last night is a very solid indication of the seriousness with which the cosponsors took the views of other delegations into consideration in coming up with a final text. There is nothing wrong with that, Mr. Chair, in fact, it is the right thing to do.

It would not be right to ignore anybody’s point of view; just as this morning I was not prepared to ignore the point of view of the distinguished Ambassador of El Salvador. But I should stress that he talked about responsibility, that we should be responsible; that is precisely what we have been, by the extensive discussions that we held, that we have conducted, and frankly, that has occupied most of my life this week. Long nights, including last night. So, to suggest that we were not acting responsibly is frankly a little difficult to swallow.

The greatest responsibility has been demonstrated here, and the greatest opportunities have been given to every delegation to make their situation known. El Salvador did not speak to me, but he spoke to you, Chair; and when I heard that he was planning to do what he did this morning, I decided to change from an acclamation to a vote.

Having heard what he said now, I assume that he is not standing in the way of a consensus, and for that I am grateful. The indication is that he will footnote this draft resolution expressing El Salvador’s particular position. That is perfectly acceptable to me as the chief proponent of this draft resolution.

So, Mr. Chair, I will now change my position, given the wisdom that we received from the distinguished Ambassador of El Salvador, a knowledge that we did not have up until he spoke this morning, and I will once again put to this Permanent Council that we a ccept this draft resolution by consensus.

And I believe that according to the rules of the Organization of American States (OAS), I do not require to have that motion seconded. We can proceed on the fact that I am asking on behalf of all

consensus.

And I believe that according to the rules of the Organization of American States (OAS), I do not require to have that motion seconded. We can proceed on the fact that I am asking on behalf of all the co-sponsors, but more than that, on behalf of all of the delegations around this table with whom consultations were conducted and agreement reached, that we should move forward now to accept this [draft] resolution by consensus.
