DRAFT DECLARATION

“SITUATION IN NICARAGUA”

(Agreed upon by the Permanent Council at its regular meeting held on June 17, 2026, and referred to the Plenary of the General Assembly for consideration)

THE GENERAL ASSEMBLY ,

REAFFIRMING the principles and purposes enshrined in the Charter of the Organization of American States and the Inter -American Democratic Charter, which recognize representative democracy and respect for human rights as essential elements of the inter-American system;

RECALLING the resolutions and declarations adopted by the General Assembly and the Permanent Council on the situation in Nicaragua;

BEARING IN MIND the international human rights obligations applicable to the State of Nicaragua, including those arising from the American Convention on Human Rights;

REITERATING the importance of promoting peaceful and sustainable solutions to political crises through dialogue, respect for human rights, and the strengthening of democratic institutions;

TAKING NOTE of the reports and findings from international human rights mechanisms, in particular the report of February 6, 2026 by the Group of Experts on Human Rights on Nicaragua (GHREN) of the Human Rights Council, the Office of the United Nations High Commissioner for Human Rights (OHCHR), the Inter-American Commission on Human Rights (IACHR) and the InterAmerican Court of Human Rights (IACHR Court), as well as in the resolution of the General Assembly of the Organization of American States (OAS) adop ted on June 27, 2024, which document serious violations and abuses committed against Nicaraguans, including allegations of transnational human rights violations, as documented by the GHREN (A/HRC/61/56);

EXPRESSES its deep concern over the human rights situation in Nicaragua, as well as over the systemic undermining of the democratic order and institutions in Nicaragua, as well as of the separation of powers and the closing of civic space.

CONDEMNS the pervasive and systemic human rights violations and abuses, documented by international mechanisms established by the United Nations Human Rights Council and the InterAmerican Commission on Human Rights, some of which, according to the latest GHREN report (A/HRC/61/56) could constitute, prima facie, crimes against humanity, and ACKNOWLEDGES the efforts undertaken by the authorities of Costa Rica to investigate the murder of a Nicaraguan citizen, including the detention and prosecution of several suspects, and reaffirms the importance of ensuring that all those responsible for the planning and execution of this crime are held accountable before justice. 1/

URGES the State of Nicaragua to comply with its domestic and international human rights obligations, to cooperate and reengage with the relevant international and regional mechanisms, and to take all measures necessary to prevent and put an end to human ri ghts violations and abuses, restore respect for fundamental freedoms, and adopt measures that enable legitimate and democratic exercise of power.

CONDEMNS the use of arbitrary detention, enforced disappearance and torture and URGES the State of Nicaragua to immediately and unconditionally release all persons arbitrarily or unjustly detained, including all persons subjected to enforced disappearance or whose fate or whereabouts remain unknown, and to cease the general use of arbitrary detentions, respect the due process and all other legal protections, including fair trial guarantees, and ensure conditions of detention, including allowing family visits and adequate medical care, are consistent with domestic and international human rights law obligations.

The United States will present a footnote.- 3EXPRESSES deep concern over the recent death of Brooklyn Rivera while in state custody, despite the precautionary measures granted by the Inter-American Commission on Human Rights and the provisional measures ordered by the Inter -American Court of Human Rights, thro ugh which the State of Nicaragua was requested to report on his detention conditions and ensure the protection of his life and personal integrity; and further expresses concern over allegations of reprisals against his relatives and members of his community.

REITERATES the importance of truth, justice, and reparation for all victims of human rights violations, including those subjected to arbitrary detention, forced exile, or persecution for exercising their human rights and fundamental freedoms, as well as th e importance of ending impunity for these and other violations.

REAFFIRMS the importance of protecting civic space and the full exercise of the freedoms of expression, association, and peaceful assembly, as well as protecting the free and independent functioning of the media and guaranteeing the participation of civil society and all sectors of society. URGES the State of Nicaragua to respect freedom of religion or belief, including the cessation and protection from acts of persecution, harassment, or undue restrictions against religious leaders and members of faith communities.

URGES the State of Nicaragua to cease steps to strip or deny its nationals of their citizenship, and to guarantee the safe return of Nicaraguan individuals abroad and in exile who wish to return to Nicaragua; to ensure full respect for their human rights and fundamental freedoms, including the rights to a nationality, freedom of movement, and to return to their own country without fear of reprisals, persecution, or arbitrary restrictions, as recognized in applicable inter -American human rights instruments.

FURTHER CALLS upon the State of Nicaragua to recognize and restore nationality and legal identity to all persons arbitrarily deprived thereof, to provide the necessary documentation to enable

RECOGNIZES the importance of continuous efforts by the international community to contribute to the protection of victims, accountability, and the restoration of democratic conditions in Nicaragua, in accordance with international law and the principle of the peaceful settlement of disputes.

RECOGNIZES the humanitarian and social effects resulting from the protracted crisis in Nicaragua, and INVITES the member states, in accordance with the applicable legal frameworks, to continue cooperating to provide protection and assistance to Nicaraguans facing risks or threats outside their country.

CALLS ON the State of Nicaragua to return to the Organization of American States, reiterating the willingness of the Member States to facilitate this process, in compliance with the provisions of the OAS Charter and in accordance with the principles of the Inter-American Democratic Charter.

REQUESTS that the Permanent Council continue to consider the situation in Nicaragua and keep the General Assembly informed of relevant developments.
