PRESENTACIÓN La Corte Interamericana de Derechos Humanos, el Instituto Interamericano de Derechos Humanos, el Instituto de Investigaciones Jurídicas de la Universidad Nacional Autónoma de México y la Fundación Konrad Adenauer han convenido la publicación de una revista que proporcione el panorama de la recepción del derecho internacional de los derechos humanos, y específicamente de la jurisprudencia de la Corte Interamericana de Derechos Humanos, por parte de los más altos órganos judiciales de los países americanos. Fue así como vio la luz Diá- logo Jurisprudencial, cuyo primer número corresponde al semestre julio-diciembre de 2006. Uno de los fenómenos más relevantes del actual desarrollo del derecho internacional de los derechos humanos, en lo que toca a su necesaria incorporación de los ordenamientos y las prácticas nacionales, es la recepción judicial que se observa a través de pronunciamientos, de diversa materia, emitidos por las cortes supremas, cortes constitucionales y salas constitucionales de un creciente número de países. De esta forma adquiere verdadera trascendencia —en lo concerniente al plano jurisdiccional, que reviste la mayor importancia— la jurisprudencia de la Corte Interamericana. Ese Tribunal internacional —o supranacional— no constituye una última instancia asociada a las instancias nacionales de conocimiento. Intérprete y aplicador de la Convención Americana sobre Derechos Humanos y de otros textos internacionales que le confieren competencia material, está llamado a examinar los derechos y libertades estipulados en aquellos instrumentos y fijar su sentido y alcance. Una vez desarrollada la interpretación del órgano judicial internacional, las instancias nacionales debieran acogerla como criterio autorizado sobre taXIII PRESENTACIÓN les instrumentos, que poseen fuerza vinculante para los Estados que los han ratificado, y por ello crean obligaciones a cargo
de éstos y definen derechos en beneficio de los particulares. La publicación de la revista Diálogo Jurisprudencial sirve al objetivo de dar a conocer el movimiento que existe en este ámbito en diversas jurisdicciones de nuestra América, para conocimiento y reflexión de funcionarios de la administración de justicia, catedráticos, investigadores y estudiantes de derecho. Esta difusión puede alentar nuevos desarrollos en otros países. El objetivo final es, claramente, consolidar la recepción nacional del derecho internacional de los derechos humanos y brindar mayor extensión y firmeza al “estatuto contemporáneo del ser humano”, beneficiario de normas nacionales e internacionales que le reconocen la titularidad de derechos y libertades, y aseguran el efectivo ejercicio de éstos. En el noveno número de la revista, que ahora tiene el lector en sus manos, aparecen once sentencias —expuestas a través de una conveniente selección de párrafos— correspondientes a Argentina, Bolivia, Colombia, Ecuador, El Salvador, México, Nicaragua, Paraguay y Uruguay. XIV FOREWORD The Inter-American Court of Human Rights, the InterAmerican Institute of Human Rights, the Institute for Juridical Investigations of the National Autonomous University of Mexico and the Konrad Adenauer Foundation have agreed to publish a journal that provides a panoramic view of the reception that international human rights law, and specifically the jurisprudence of the Inter-American Court of Human Rights, has had among the highest judicial bodies in American
states. Thus, Jurisprudential Dialogue was born; its first edition corresponds to the July-December 2006 semester. One of the most relevant trends in the present development of international human rights law, concerning the necessary incorporation of international human rights law into national practice and regulation, is the judicial reception observed through pronouncements of various kinds by Supreme Courts, Constitutional Courts and Constitutional Courtrooms in an increasing number of countries. Accordingly, the Inter-American Court’s jurisprudence acquires true transcendence in the jurisdictional sphere, which is of the utmost importance. This international or supranational Tribunal does not constitute an appellate court to decisions made by national courts. As interpreter and applier of the American Convention on Human Rights and other international texts that confer upon it material jurisdiction, the Court is called to examine the rights and freedoms stipulated within those instruments and to establish their meaning and reach. Once the international judicial body has developed said interpretation, national courts must adopt it as an authoritative interpretation that binds countries that have XV FOREWORD ratified those instruments, and thus creates obligations for those states and defines individual rights. The publication of the journal Jurisprudential Dialogue serves to provide an understanding of the developments in this field in an array of America’s jurisdictions, in order that judicial authorities, professors, investigators and law students may draw knowledge and reflection from this source. Such diffusion may encourage new developments in other countries as well. The final objective is, clearly, to encourage the national integration of international human rights law and to strengthen and improve the “contemporaneous status of the human being” as a beneficiary of national and international norms that recognize these rights and liberties and assure their effective exercise. In the ninth edition of the journal, now in the hands of readers, eleven judgments are provided —transcribed wholly or in part through an appropriate selection of paragraphs when it concerns extensive resolutions— that correspond to Argentina,
Bolivia, Colombia, Ecuador, El Salvador, Mexico, Nicaragua, Paraguay and Uruguay. Sinopsis: En la presente sentencia la Corte Suprema de Justicia de la Nación de Argentina resolvió un recurso de queja interpuesto por el Fiscal General en contra de una decisión de la Cá- maraNacionaldeCasaciónPenaldeesepaís.Taldecisiónhabía hecho lugar a un recurso de casación e inconstitucionalidad mediante el cual la Cámara declaró la inconstitucionalidad del artículo 1o. de la Ley 22.278, relativa al Régimen Penal de la Minoridad, y ordenó a diversas autoridades la adopción de ciertas medidas para, entre otros, adecuar la legislación penal en materia de menoresa nuevosestándaresconstitucionalesen la materia y establecer un sistema integral y coordinado con la Ley 26.061, relativo a la Protección Integral de los Derechos de las Niñas, Niños y Adolescentes. A tal efecto, la Cámara Nacional de Casación Penal estableció plazos concretos y un mecanismo de informes bimestrales para ser informada sobre los avances al respecto.
En su decisión, la Corte Suprema de Justicia hizo un análisis de los estándares internacionales sobre derechos humanos de los menores de edad. Entre otros, señaló que conforme a la Convención sobre los Derechos del Niño se entiende que éstos gozan de todos los derechos humanos en tanto personas pero que, a su vez, se debe proporcionar a los niños una protección especial en términos de derechos, libertades y garantías concretos a los que los Estados deben dar efectividad. Uno de los principios estable1 “SITUACIÓNIRREGULAR”DEMENORESYSUAPLICACIÓN cidos en tal Convención es el relativo al trato a que tienen derecho los niños de quienes se alegue que han infringido las leyes penales.Entalescasos,lasmedidasquedebenadoptarlosEstadosdebenestarorientadasaltratamientodelosniñossinquese recurraaprocedimientosjudiciales,siemprequeseaapropiadoy deseable. Asimismo, haciendo alusión a la jurisprudencia de la Corte Interamericana de Derechos Humanos, la Corte Suprema señaló que la jurisdicción especial para niños en conflicto con la leyylasnormasyprocedimientoscorrespondientesdebencaracterizarse, entre otros, por la posibilidad de adoptar medidas para tratar a los niños sin que se recurra a procedimientos judiciales. En caso de ser necesario un proceso judicial, deben disponerse medidas especiales en atención a su situación de vulnerabilidad, también cuando esté en juego su derecho a la libertad personal, el cual no puede deslindarse del principio del interés superior del niño. Teniendo en cuenta lo anterior, uno de los temasabordadosporlaCorteSupremafueelrelativoaladoctrina de la “situación irregular” del menor que se desprende de la Ley 22.278. Señaló, siguiendo lo expresado por el Comité de los Derechos del Niño a la Argentina, que dicha doctrina no traza una distinción clara entre niños que necesitan protección y cuidado como, por ejemplo, aquéllos provenientes de familias pobres y que son colocados en instituciones de asistencia pública o en internados,yniñosenconflictoconlaleypenal. La Corte Suprema de Argentina revocó la sentencia objeto del recurso de queja con base en que, si bien no era censurable por
el dictamen que formulaba acerca de los defectos del sistema vigente sobre el tratamiento de menores de edad en conflicto con la ley, la Cámara Nacional de Casación Penal había excedido el cometido del Poder Judicial fijado por la Constitución Nacional argentina al dictar una sentencia con carácter de norma general derogatoriayordenandolaimplementacióndeunmecanismode reemplazoensulugar,cuandolasolucióndelproblemarequería de la concreción de medidas de política pública previas correspondientes a otros poderes del Estado. No obstante lo anterior, la Corte Suprema señaló que no podía permanecer indiferente ante la gravedad de la situación y la demora en proceder a una adecuación de la legislación vigente en la materia, entre otros, a laConvenciónsobrelosDerechosdelNiño.Entalsentido,requirióalPoderLegislativoparaque,enunplazorazonable,adecuara la legislación a los estándares mínimos pertinentes derivados 2 CORTESUPREMADEJUSTICIAARGENTINA de los instrumentos internacionales sobre derechos humanos, y alosPoderesEjecutivosnacionalylocalparaqueatravésdelos organismos administrativos correspondientes, adoptaran en un plazo razonable lasmedidasde sucompetencia.Porlo que se refiere al Poder Judicial, con base en jurisprudencia de la Corte Interamericana conforme a la cual los deberes de los Estados de respetar y garantizar los derechos reconocidos en la Convención Americana sobre Derechos Humanos incumben a cualquier poder y órgano independientemente de su jerarquía, la Corte Suprema señaló que entre las “medidas de otra índole” (artículo 2
de la Convención Americana) que los Estados deben adoptar para garantizar los derechos humanos están las sentencias judiciales. Los tribunales están obligados a atender como consideración primordial al interés superior del niño. Estableció que, en tal sentido, corresponde a los jueces velar por el respeto de los derechos de los niños y adolescentes bajo su jurisdicción, lo cual implica escucharlos con todas las garantías a fin de hacer efectivos tales derechos. También corresponde a los jueces mantener un conocimiento personal, directo y actualizado de las condiciones en las que se encuentran los niños sujetos a internación con el fin de adoptar las medidas que sean de su competencia y que tengan como efecto directo un mejoramiento en la calidad de vida de los niños. En relación con los niños que cometen un delito cuando todavíano hancumplido laedadmínima,corresponde a los jueces adoptar medidas especiales orientadas, principalmente, hacia servicios sustitutivos de la internación teniendo como guía el principio del interés superior del niño, según sus circunstanciasparticulares. En su sentencia, la Corte Suprema de Justicia de Argentina se basó, entre otros, en las sentencias dictadas por la Corte Interamericana de Derechos Humanos en los casos “Instituto de Reeducación del Menor” vs. Paraguay, “Niños de la Calle” (Villagrán Morales y otros) vs. Guatemala, y “La Última Tentación de Cristo”(OlmedoBustosyotros)vs.Chile. THEDOCTRINEOFTHE“IRREGULARSITUATION” OFMINORSANDITSAPPLICATIONISCONTRARY TOTHEINTERNATIONALHUMANRIGHTS STANDARDSOFTHEMINORBECAUSE ITDOESNOTDISTINGUISHBETWEENCHILDREN INNEEDOFCAREANDPROTECTION ANDTHOSEINCONFLICTWITHTHELAW,INTERMS OFJUDICIALPROCEDURESANDTREATMENT Synopsis: In this judgment, the Supreme Court of Justice of Argentina solved a remedy of complaint filed by the Attorney General of the Republic against a decision rendered by the National Chamber for Cassation in Criminal Matters. By means of such decision, it was admitted an appeal for annulment and a constitutional motion by which the Chamber declared the unconstitutionality of article 1 of Law 22.278, related to Minors Criminal Responsibility and ordered several authorities to adopt certain measures to, among other aspects, adapt the criminal legislation related to minors to new constitutional standards in the matter and to establish a comprehensive system in coordination with Law26.061relatedtotheComprehensiveProtectionoftheRights of Children and Adolescents. To that end, the National Chamber for Cassation in Criminal Matters set specific deadlines and a mechanism of bi-monthly reports to be informed on the progress madeinthisregard. Initsdecision,theSupremeCourtofJusticemadeananalysisof the international human rights standards of minors. Among other aspects, it pointed out that according to the Convention on the Rights of the Child, the children enjoy all human rights in their condition as persons but that, at the same time, they must be provided with special protection in terms of specific rights, freedoms and guarantees and States must give effect to them. One of the principles established in such Convention is the one related to the treatment that must be given to those children who are accused of violating criminal laws. In such cases, the measuresStatesmustadoptmustbeorientedtothetreatmentofchildren without resorting to judicial proceedings, whenever it is appropriate and desirable. Moreover, in reference to the case-law of 4 CORTESUPREMADEJUSTICIAARGENTINA the Inter-American Court of Human Rights, the Supreme Court pointed out that the special jurisdiction for children in conflict with the law and the corresponding rules and proceedings must be characterized, among others, by the possibility of adopting measures to treat children without resorting to judicial proceedings.Shouldajudicialproceedingbenecessary,specialmeasures must be ordered bearing in mind the situation of defenselessness of the minor, also when the minor’s right to personal freedom is at risk, which cannot be viewed in isolation from the principle of thebestinterestofthechild.Basedontheforegoing,oneoftheissues addressed by the Supreme Court was the one related to the doctrineof the“irregularsituation”of theminor,asderivedfrom Law 22.278. It pointed out, following what was indicated by the CommitteeontheRightsoftheChildtoArgentina,thatsaiddoctrine does not clearly distinguish between the children in need of care and protection, those children from poor families who are placed in public assistance institutions or residential homes and thoseinconflictwiththelaw. The Supreme Court of Argentina revoked the judgment which was the subject of the remedy of complaint based on that, even though it was not reprehensible based on the pronouncement issued about the defects in the system in force in relation to the treatment of minors in conflict with the law, the National Chamber for Cassation in Criminal Matters had exceeded the competence of the Judicial Branch as established by the Argentine National Constitution when it delivered a judgment with the force of a repealing general rule and ordered the implementation of another mechanism, when the solution to the problem required
theprioradoptionofpublicpolicymeasuresthatcorrespondedto other branches of the government. Without detriment to the foregoing, the Supreme Court pointed out that it cannot remain indifferenttowardstheseriousnessofthesituationandthedelayin adapting the current legislation in the matter, among other aspects,totheConventionontheRightsoftheChild.Tothisend,it requested the Legislative Branch to, within a reasonable time, adapt the legislation to the corresponding minimum standards established in international human rights treaties, and the national and local Executive Branch to, by means of the corresponding administrative bodies, adopt measures within its sphere of competence, within a reasonable time. As to the Judicial Branch, based on the case-law of the Inter-American Court 5 “SITUACIÓNIRREGULAR”DEMENORESYSUAPLICACIÓN according to which States’ duty to respect and guarantee the rights enshrined in the American Convention on Human Rights is incumbent on any branch and body independently of its hierarchy, the Supreme Court pointed out that the “other measures” (article 2 of the American Convention) that States Parties must adopt to guarantee the human rights include the judicial decisions. Courts are obliged to take into account, in the first place, thechild’sbestinterest.Itestablishedthat,inthisregard,itfalls upon the judges to ensure to the children and adolescents subject to their jurisdiction the respect for their rights, which imply to provide them with all the guarantees in order to give effect to theirrights.Italso fallsuponthejudgesto personally know,ina directandupdatedmanner,theconditionofthechildrenwhoare placed in institutions in order to adopt the corresponding measures so as to improve the child’s living conditions in such institutions. In relation to the children who commit a crime but who are below the minimum age, it is up to the judges to adopt special measures addressed to, mainly, provide them with alternative services of treatment taking into account, as guideline, the principleofthebestinterestofthechild,accordingtotheparticularcircumstances.
